The instant writ petition has been filed for mandamus commanding the Respondent No.2 not to interfere with the peaceful and cultivator possession of the petitioners over the land bearing Khasra No. 282/1M, area about 16.996 hectare and 282/M, area 4.047 hectare, total area 21.043 hectare, situated in village Jahingirpur Khadar, Pargana and Tehsil Mant, District Mathura. 3. Counsel for the petitioners submitted that petitioners are recorded tenure holder of plot in dispute. He further submitted that authorities are interfering with the possession of the petitioners without following due procedure of law. He further submitted that petitioners have not encroached any land of the State, as such, the State authorities cannot interfere with the peaceful possession of the petitioners without following due procedure of law. He further submitted that even the application/representation filed by petitioners for redressal of their grievance, has not been considered. 4. On the other hand Mr. Abhishek Shukla, learned Additional Chief Standing Counsel on the basis of the instruction dated 10.3.2023 , submitted that total area of Plot No. 282 is 84.809 hectare. He further submitted that Plot No. 282/2M, area 27.192 hectare is recorded as 'Ret' in the revenue record and out of 27.192 hectare area of Plot No. 282/2M, area measuring 15 hectare has been given for 10 years plantation lease to the Forest Department Social Forestry, Mathura. He further submitted that petitioners are recorded over 21.043 hectare area of Plot No. 282/1M and 282/2M and there is no interference with the petitioners' right and possession with respect to the area mentioned above. He submitted that no interference is required in the matter and the writ petition is liable to be dismissed. 5. This Court has directed the learned standing counsel to obtain instruction and file counter affidavit, accordingly, instruction dated 10.3.2023 sent by Assistant Record Officer, Mathura is already on record of the case.

7. There is no dispute about the fact that the petitioners are recorded tenure holders of Plot No. 282/1M, area 16.996 hectare and Plot No. 282/2M, area 4.047 hectare, total area 21.043 hectare. 8. जिहवाहाँगयीर खिवादर तहसयील ममॉट , धजिलवा मथनुरवा सवरकण एवसं अचभलसेखि चक्रियवाओसं कसे अन्तगरत हहोनसे कसे कवारण सहवायक अचभलसेखि अधधिकवारयी मथनुरवा कसे कसेत्रवान्तगरत हह। अतह सम्बसन्धित मसौजिवा कसे लसेखिपवाल , सवर कवानपूनगहो एवसं नवायब तहसयीलदवार सवर ससे आख्यवा प्रवाप्त ककी गययी। जिहो चक आख्यवा चदनवासंक 10-3-2023 चनम्नवतत् हहह- “1- यह प्रकरण ससौभरर वन कसे समयीप सस्थत जिहवाहाँगयीरपनुर खिवादर मम उपलब्धि रसेत दजिर भपूचम खिसरवा नम्बर-282 रकबवा 84.809 हसे० मम ससे 15 हसेक्टसेयर भचम कहो 10 वषिर्षीय पटसे पर ससौभरर वन ककी भवाहाँचत ववृकवारहोपण हसेतनु प्रस्तवाचवत चकयसे जिवानसे व चवकधसत चकयसे जिवानसे ककी कवायरववाहयी ससे सम्बसन्धित हह। खितसौनयी ककी छवायवाप्रचत ससंलग्न हह। 2- सहवायक अचभलसेखि अधधिकवारयी मथनुरवा पत्र ससं० 437 चदनवासंक 23-12-2022 दवारवा यह अवगत करवायवा गयवा चक रवाजिस्व गवाम जिहवाहाँगयीरपनुर खिवादर कसे खिसरवा नम्बर -282 रकबवा 84.809 हसे० मम ससे 15 हसेक्टसेयर भपूचम कहो 10 वषिर्षीय पटसे पर चदयसे जिवानसे हसेतनु उपधजिलवाधधिकवारयी ममॉट कसे आदसेश चदनवासंक 20- 12-2022 कसे तहत प्रश्नगत खितसौनयी मम अभ्यनुचक दजिर कर दयी गययी हह। परववानवा अमल दरवामद चदनवासंक 20-12-2022 ककी छवायवा प्रचत ससंलग्न हह। 3- कवायर कसे महत्व एवसं समयबद्धतवा कहो दृचष्टगत रखितसे हहयसे , प्रभवागयीय चनदसेशक, सवामवाधजिक ववाचनककी वन प्रभवाग मथनुरवा कसे कवायवारलय पत्र ससं० 3722 चदनवासंक 23-12-2022 कसे क्रिम मम उक भपूचम कहो अचतक्रिमण मनुक करवाकर उपलब्धि करवानसे हसेतनु मधजिस्टट सेट नवाचमत करनसे कवा अननुरहोधि चकयवा गयवा। 4- प्रभवागयीय चनदसेशक, सवामवाधजिक ववाचनककी वन प्रभवाग मथनुरवा दवारवा चकयसे गयसे अननुरहोधि पत्र कसे क्रिम मम कवायवारलय धजिलवाधधिकवारयी मथनुरवा कसे आदसेश /पत्र ससं० 3956/14-1 मथनुरवा चदनवासंक 3-1-2022 कसे तहत प्रश्नगत भपूचम कहो अचतक्रिमण मनुक करवानसे हसेतनु शयीमतयी प्रयीचत जिहन , सहवायक अचभलसेखि अधधिकवारयी/चडप्टयी कलसेक्टर कहो मधजिस्टट सेट नवाचमत करतसे हहयसे चनधिवारररत चतधथ 5-1-2023 ससे 6-1- 2023 चनयत करतसे हहयसे वन चवभवाग ससे समन्वय स्थवाचपत कर मसौकसे पर उपसस्थत हहोकर चनयमवाननुसवार आवश्यक कवायरववाहयी पपूणर करवाकर ररपहोटर उपलब्धि करवानसे हसेतनु चनदरचशत चकयवा गयवा। आदसेश चदनवासंक 3- 1-2022 ककी छवायवाप्रचत ससंलग्न हह। 5- यवाचयीगण कवा कथन हह चक उनकसे दवारवा धजिलवाधधिकवारयी मथनुरवा एवसं उच्चवाधधिकवाररयसों कहो चशकवायतयी प्रवाथरनवा पत्र इस आशय ससे प्रसेचषित चकयसे गयसे चक वह खिसरवा नसं० 282 कसे हयी कवाश्तकवार हह इसयी खिसरवा नम्बर मम 27 हसेक्टसेयर रसेत खिवातसे ककी हह धजिस पर प्रवाथर्षीगण कवा अनवाधधिकवार कब्जिवा नहहीं हह प्रवाथर्षीगण कहो खितसौनयी मम दजिर उनकसे खिवातसे ककी भपूचम ससे बसेदखिल चकयवा जिवा रहवा हह। अतह प्रवाथर्षीगण कसे कब्जिसे ससे छसेड़छवाड़ न ककी जिवायसे। इस सम्बन्धि मम सवादर अवगत करवानवा हह चक- खिसरवा नसं० 282 कवा कनु ल रकबवा 84.809 हसेक्टसेयर हह। इसयी खिसरवा नम्बर 282/2 चम० मम रकबवा 27.192 हसेक्टसेयर रसेत दजिर कवागजिवात हह धजिसमम ससे मवात्र 15.000 हसे० भपूचम कहो ववृकवारहोपण हसेतनु 10 वषिर्षीय पटसे पर कवायवारलय प्रभवागयीय चनदसेशक, सवामवाधजिक ववाचनककी वन प्रभवाग मथनुरवा कहो उपधजिलवाधधिकवारयी ममॉट कसे आवसंटन चदनवासंक 20-12-2022 पर सहवायक अचभलसेखि अधधिकवारयी मथनुरवा कसे आदसेश चदनवासंक 22-12-2022 कसे अननुपवालन मम चदनवासंक 22-12-2022 कहो खितसौनयी दजिर चकयवा गयवा हह। उपरहोक खिसरवा नसं० 282 मम खिसरवा नम्बर 282/1 चम० रकववा 16.996 हसेक्टसेयर तथवा 282/2 चम० रकववा 4.047 हसे० कनु ल रकववा 21.043 हसेक्टसेयर लगवानयी 52.00/-रूपयसे पर यवाचयीगण कवा नवाम बतसौर ससंक्रिमणयीय भपूचमधिर खितसौनयी मम दजिर हह। उपरहोकवाननुसवार खिसरवा नम्बर 282 मम जिहो भपूचम यवाचयीगण कसे नवाम दजिर हह, ससे यवाचयीगण कवा अवहधि कब्जिवा मवानकर उन्हम बसेदखिल नहहीं चकयवा गयवा हह बसलक सरकवारयी रसेत दजिर भपूचम ससे यवाचयीगण एवसं अन्य व्यचकयसों कसे अवहधि कब्जिसे कहो उपरहोक वन चवभवाग कसे ववृकवारहोपण हसेतनु 10 वषिर्षीय पटसे पर आरचकत भपूचम ससे चदनवासंक 5-1-2023 मम अवहधि अचतक्रिमण कहो हटवायवा गयवा हह। धजिसससे यवाचयीगण कसे अधधिकवार प्रभवाचवत नहहीं हहोतसे हह।” आख्यवा चदनवासंक 10.3.2023 ककी छवायवाप्रचत ससंलग्नक -02 हह। 4- यह चक उपरहोकवाननुसवार स्पष्ट हह चक मसौजिवा जिहवाहाँगयीरपनुर कवा खिसरवा नम्बर -282 एक बड़वा नम्बर हह धजिसमम यवाचयीगण कसे चनजियी खिवातसों ककी भपूचम ससंक्रिमणयीय भपूचमधिरयी हह तथवा इसयी खिसरवा नसं० 282 मम हयी रसेत दजिर सरकवारयी भपूचम धिवारवा 132 यपू०पयी०जिहड०ए०एक्ट तथवा वतरमवान अधधिचनयम उ०प्र०रवाजिस्व ससंचहतवा 2006 ककी धिवारवा-77 ससे आच्छवाचदत हह धजिससे यमनुनवा कटवान रहोकनसे व ससौभरर वन कसे समयीप स्थवाचपत हहोनसे कसे कवारण ववृकवारहोचपत चकयवा जिवानवा हह। तदननुसवार हयी इस सरकवारयी भपूचम कहो अचतक्रिमण मनुक करवायवा गयवा हह। 5- यह चक मवाननयीय उच्च न्यवायवालय दवारवा जिहो भयी आदसेश /चनदरश उत्तरदसेय प्रचतपकयीगण कसे ववास्तसे जिवारयी चकयसे जिवायसेगम, उसकवा अकरशह अननुपवालन चकयवा जिवायसेगवा। रहस्पहोण्डसेन्टसत् (प्रयीचत जिहन) सहवायक अचभलसेखि अधधिकवारयी,मथनुरवा। 9. The perusal of the instruction dated 10.3.2023 reveals that total area of Plot No.282 is 84.809 hectare and 27.192 hectare area of Plot No 282/2M is recorded as "Ret" in the revenue record and out of 27.192 hectare area of Plot No. 282/2M area, 15 hectare has been given for plantation lease for 10 years to the Social Forestry, Forest Department , Mathura. There is also clear avernment in the instruction that there is no interference with the petitioner's right, title and possession over which they are recorded rather respondents are maintaining the public utility plot which is recorded as "Ret". It is also mentioned in the instruction dated 10.3.2023 that Ret Land will come under section 132 of U.P.Z.A. and L.R. Act/section 77 of U.P. Revenue Code, 2006 and in order to protect the land from river Yamuna, the plantation lease has been granted to Social Forestry, Mathura. 10. Considering the entire facts and circumstances, revenue entry and the instruction dated 10.3.2023 sent by Assistant Record Officer, Mathura, it is established that there is no interference with the petitioners' right and title with respect to the plot and area over which they are recorded, hence no interference is required in the matter in exercise of jurisdiction under Article 226 of Constitution of India.

Decision
