Heard Sri Ajay Dubey, learned counsel for the applicant, Sri Shashi Kant Pandey, learned counsel for the State and perused the record. This application under Section 482 Cr.P.C. has been filed by the applicant Smt. Kusumlata with the prayer to allow this application and direct the trial Court to conclude and decide the trial expeditiously if possible within three months of Misc. Case No. 125 of 2019, Deepak Sharma Vs. Kusumlata arising out of Case No. 1158 of 2018, Smt. Kusumlata Vs. Deepak Sharma under Section 12 of Protection of Women from Domestic Violence Act, 2005, P.S. Etmadadaulla, District Agra, pending in the court of Addl. Chief Judicial Magistrate Court No. 10, Agra. Learned counsel for the applicant argued that the applicant is the wife of opposite party no.2 and it is stated that the proceedings under the provision of Domestic Violence Act, 2005 pending since 2018 as such appropriate direction be issued for disposal of trial in time bound manner. Per contra, learned State counsel opposed the prayer made in the present matter by arguing that no such specific reasons have been made out for giving any direction for expediting the trial of the case and as such the application be dismissed. After having heard learned counsel for the parties and perusing the record, it is evident that there is no specific reason for expediting the trial. However, the applicant of the wife of opposite party no.2 of the case, may file an application for expediting the trial before the court concerned within two weeks from today, it may as per its load of work and diary, pass appropriate orders on the same within two weeks.
