According t o t hem , respondent nos.5, 6 and 7, who are cousins of pet it ioner no.1, are int erfering t he work of renovat ion of school building. I n paragraph no.7 of t he writ pet it ion, it is m ent ioned t hat respondent nos.5 t o 7 reside wit hin t he school prem ises.
2. By m eans of t his pet it ion, pet it ioners have sought t he following reliefs: “ 1. I ssue a writ , order or direct ion in t he nat ure of Mandam us com m anding t he respondent aut horit ies t o im m ediat e, cont inuous and adequat e police provide t he prem ises of St . George's Academ y prot ect ion at School so as t o ensure t he safet y and securit y of t he pet it ioners, st udent s, t eaching and non- t eaching st aff, m anagem ent and visit ors, and t o m aint ain peace, discipline and public order wit hin t he educat ional cam pus. 1 int im idat ion, coercion, I ssue a writ , or der or direct ion com m anding t he 2. t o prevent any obst ruct ion, respondent aut horit ies dist urbance, t hreat or unlawful int erference by Respondent Nos. 5 t o 7, or by any person act ing on t heir behalf, in t he day- t o- day funct ioning of t he school, including academ ic act ivit ies, classroom t eaching, exam inat ions, m orning assem blies, playground act ivit ies, sport s and physical educat ion, cult ural and co- curricular program m es, st aff dut ies and adm inist rat ive operat ions.
3. t he I ssue a writ , or der or direct ion com m anding respondent aut horit ies t o ensure and facilit at e t hat all renovat ion and reconst ruct ion, developm ent , lawful m aint enance works undert aken by t he Pet it ioners- including boundary wall reconst ruct ion, com pliance wit h st ruct ural PWD direct ions, whit ewashing, paint ing, repairs, playground m aint enance and levelling, safet y m easures, and inst allat ion, repair or upkeep of school infrast ruct ure- are carried out peacefully, safely and int erference, wit hout int im idat ion or unlawful act on t he part of Respondent Nos. 5 t o 7 or any per son act ing at t heir behest . int errupt ion, and wit hout any

Learned St at e Counsel is right in subm it t ing t hat t he reliefs sought by pet it ioners in t his writ pet it ion can only be grant ed by a Civil Court as t he pet it ioners have sought an order in t he nat ure of inj unct ion. Law is well set t led t hat propert y right s or civil disput e cannot be set t led in a public law rem edy under Art icle 226 of t he Const it ut ion of I ndia. We, t herefore, decline t o int erfere in t he m at t er.
