The Ant icipat ory Bail Applicat ion ( No.1286 of 2025) of t he applicant s has been rej ect ed by t he learned Sessions Judge, Udham Singh Nagar on

10.11.2025. 3 . According t o t he respondent , t he applicant s 1 and t wo ot hers were direct ors of Real Reliable Agroland Com pany Lim it ed. On 17.10.2013, Balram Yadav, Balj it Singh and Vij ay Sharm a, t he officers of t he said Com pany, t old t he inform ant t hat if he invest s in t he said Com pany, his am ount will be increased in six years. The inform ant had purchased several policies, but his m oney was not refunded. The First I nform at ion Report has been regist ered on 29.06.2024 against t he applicant s and five ot her co- accused. 4 . Heard Mr. Pankaj Singh Chauhan, learned counsel for t he applicant s and Mr. Deepak Bhardwaj , learned Brief Holder for t he respondent . 5 . Mr. Pankaj Singh Chauhan, Advocat e, cont ended t hat t he allegat ions of t he First I nform at ion Report against t he applicant s are false. The applicant s resigned t he said Com pany on 11.02.2016 ( Annexure No.2) and t heir resignat ions were accept ed in t he m eet ing dat ed 23.02.2016 of t he Board of Real Reliable Agroland Com pany Lim it ed. Applicant s have not been convict ed by any Court . Applicant no.1 is a perm anent resident of Dist rict Moradabad, Ut t ar Pradesh and t he applicant no.2 is a perm anent resident of Dist rict Sam bhal, Ut t ar Pradesh, t herefore, t here is no possibilit y of t heir absconding. They were not 2 arrest ed during t he invest igat ion. All t he relevant docum ent s were t aken by t he I nvest igat ing Officer. Now, charge- sheet has been filed, t herefore, t here is no chance of t am pering wit h t he evidence. 6 . Mr. Deepak Bhardwaj , learned Brief Holder, has opposed t he ant icipat ory bail applicat ion orally. 7 . Personal libert y under Art icle 21 of t he Const it ut ion of I ndia is very precious fundam ent al right it should be curt ailed only when it becom es im perat ive according t o t he peculiar fact s and circum st ances of t he case. 8 . Having heard t he subm issions of learned counsel for t he part ies and keeping in view of t he fact s and circum st ances of t he case, wit hout com m ent ing on t he m erit s of t he case, t he present Applicat ion, filed for ant icipat ory bail, is allowed. I t is direct ed t hat in t he event of t he arrest of t he applicant s Sm t . Yasm een Khan and I rshad Ahm ad, t hey shall be released on ant icipat ory bail on execut ing a personal bond of Rs. 30,000/ - and t wo reliable suret ies, each of t he like am ount , by each one of t hem , t o t he sat isfact ion of t he I nvest igat ing Officer/ Arrest ing Officer, subj ect t o t he following condit ions: - ( i) Applicant s shall at t end t he t rial court 3 regularly and t hey shall not seek any unnecessary adj ournm ent ; ( ii) Applicant s shall not direct ly or indirect ly m ake any inducem ent , t hreat or prom ise t o any person, acquaint ed wit h t he fact s of t his case; ( iii) Applicant s shall not leave t he count ry wit hout t he previous perm ission of t he t rial court . 9 .
