6. Pet it ioners are int erest ed in t aking adm ission in LL.B. five years course in t o HNB Garhwal colleges affiliat ed ( Cent ral) Universit y. Since t hey have not appeared in Cent ral Universit y Ent rance Test - 2025 nor Universit y Ent rance Test - 2025, which adm ission in UG/ PG Courses, including LL.B. Course, t hey ineligible t he LL.B. Course. is now m andat ory for adm ission t herefore, t o

By m eans of pet it ioners have sought reliefs: - t his writ pet it ion, following t he “ i. issue a writ , order or direct ion in t he nat ure of m andam us direct ing t he Respondent Universit y t o allow t he adm ission of Pet it ioner no. 1 and 2 in B.A.L.LB Course in Session 2025- 2026 on t he in qualifying exam inat ion; or of m arks obt ained ii. issue a writ , order or direct ion in t he nat ure of m andam us direct ing t he Respondent Universit y for not insist ing on t he condit ions laid down in Circular/ Not ificat ion dat ed 30.09.2025 ( Annexure- 14) wit h regard t o appearing in UET Exam inat ion for adm ission in L.LB and BA.L.LB Courses; and iii. I ssue a writ , order or direct ion in t he t he Respondent nat ure of m andam us direct ing Universit y t he SOP dat ed 07.06.2024 ( Annexure- 7) in order t o allow t he adm issions on t he in qualifying exam inat ions.” of m arks obt ained follow t o I ndia respect of t he 8. Bar Council regulat ory body educat ion. Rules of Legal Educat ion, 2008 fram ed by Bar Council of I ndia are applicable for det erm ining eligibilit y of a candidat e for adm ission in LL.B. Course. Rule 7 of t he said Rules is ext ract ed below: - “ 7 . M i n i m u m m a r k s i n q u a l i f y i n g e x a m i n a t i o n f o r a d m i ssi o n Bar Council of I ndia m ay from t im e t o t im e, st ipulat e t he m inim um percent age of m arks not below 45% of t he t ot al m arks in case of general cat egory applicant s and 40% of t he t ot al m arks in case of SC and ST applicant s, t o be obt ained for t he qualifying exam inat ion, such as + 2 Exam inat ion in case of I nt egrat ed Five Years' course or Degree course for Three years' LL.B. course, for t he purpose of applying for and get t ing int o a Law Degree Program of any adm it t ed recognized Universit y in eit her of t he st ream s. in any discipline Provided t hat such a m inim um qualifying m arks shall not aut om at ically ent it le a person t o get adm ission int o an inst it ut ion but only shall ent it le t he person concerned t o fulfill ot her inst it ut ional crit eria not ified by t he inst it ut ion concerned or by t he governm ent concerned from t im e t o t im e t o apply for adm ission.”

9. Perusal of t he aforesaid Rules indicat es t hat whenever t he Universit y has laid down any inst it ut ional crit eria for t hen adm ission every candidat e desirous of adm ission in LL.B. Program m e has t hose eligibilit y crit eria. t o LL.B. Program m e, t o m eet

10. HNB Garhwal ( Cent ral) Universit y has issued a not ificat ion on 30.09.2025, whereby applicat ions were / LL.M. Program m e adm ission only from such st udent s who appeared in t he Universit y Ent rance Exam inat ion ( UET) - 2025- 26. in LL.B. invit ed

Since pet it ioners have not appeared in UET and adm it t edly t hey have also not appeared in CUET held by Cent ral Governm ent , t herefore, as per t he said not ificat ion, pet it ioners are not eligible. Wit hout m eet ing t he eligibilit y crit eria specified by t he Universit y for adm ission in LL.B. Course, t here cannot be any direct ion in favour of pet it ioners t o get t hem adm ission in t he cam pus colleges t o HNB Garhwal or colleges affiliat ed ( Cent ral) Universit y.

12. Thus, t his Court do not find any reason t o int erfere in t he m at t er. The writ pet it ion fails and is dism issed.
