Applicant m oved an applicat ion under Sect ion 195( 1) ( i) of Code of Crim inal Procedure, 1973 t o punish t he police officers by alleging t hat he was wrongly Chandipul, Haridwar, while act ually he was arrest ed from St at e of Bihar. The said applicat ion was rej ect ed by learned F.T.S.C./ Addit ional Judge, Haridwar, vide order dat ed 11.07.2024. Feeling aggrieved, by t he order passed learned Addit ional Sessions Judge, applicant has filed t his applicat ion under Sect ion 528 BNSS, 2023. Sessions

5. Sect ion 195 ( 1) Cr.P.C., which is relevant t o t he present case, is ext ract ed below: - f o r co n t e m p t o f “ 1 9 5 . Pr o se cu t i o n a u t h o r i t y o f p u b l i c se r v an t s, a g a i n st p u b l i c r e l a t i n g t o d o cu m en t s g i v e n i n e v i d en ce — ( 1 ) No Court shall t ake cognizance— l a w f u l f o r o f f e n ce s f o r o f f e n ces j u st i ce a n d ( a ) ( i ) of any offence punishable under sect ions 172 t o 188 ( bot h inclusive) of t he I ndian Penal Code, ( 45 of 1860) , or ( i i ) of any abet m ent of, or at t em pt t o com m it , such offence, or ( i i i ) of any cr im inal conspiracy t o com m it such offence, except on t he com plaint in w rit ing of t he public servant concerned or of som e ot her public servant t o whom he is adm inist rat ively subordinat e; ( b) ( i ) of any offence punishable under any of t he follow ing sect ions of t he I ndian Penal Code ( 45 of 1860) , nam ely, sect ions 193 ( bot h inclusive) , 199, 200, 205 t o 211 ( bot h inclusive) and 228, when such offence is alleged t o have t o, any been com m it t ed proceeding in any Court , or t o 196 relat ion in, or ( i i ) of any offence described in sect ion 463, or punishable under sect ion 471, sect ion 475 or sect ion 476, of t he said Code, when such offence is alleged t o have been com m it t ed in respect of a docum ent produced or given in evidence in a proceeding in any Court , or ( i i i ) of any crim inal conspiracy t o com m it , or at t em pt t he abet m ent of, any offence specified in sub- clause ( i) or sub- clause ( ii) , t o com m it , or except on t he com plaint in wr it ing of t hat Court or by such officer of t he Court as t hat Court m ay aut horise in wr it ing in t his behalf, or of som e ot her Court t o which t hat Court is subordinat e.”

A careful perusal of Sect ion 195 ( b) ( i) would reveal t hat no Court can t ake cognizance of any offence punishable under Sect ion 193 t o 196, except on t he com plaint in writ ing of t hat Court or by such Officer of t he Court as t hat Court m ay aut horise in writ ing in t his behalf, or of som e ot her Court t o which t hat Court is subordinat e. Thus a com plaint m ade by privat e person is not m aint ainable under Sect ion 195 ( b) ( i) Cr.P.C. Thus, t here is no infirm it y in t he
