8. From t he order of t his Court , passed in earlier wr it pet it ion, it is apparent t hat t he com pet ent aut horit y was direct ed t o t ake decision. Mr. Lalit Sharm a, Advocat e concedes t hat aut horit y com pet ent for t aking decision is Direct or, AI I MS, Rishikesh. Thus from t he subm ission m ade on behalf of respondent s also, it is revealed t hat t he com pet ent aut horit y did not apply his m ind t o t he represent at ion m ade by pet it ioner alt hough he was under 2 a dut y t o t ake decision in t he m at t er aft er considering t he represent at ion. Mere grant of approval by t he com pet ent aut horit y t o t he order passed by Adm inist rat ive Officer will not validat e an ot herwise invalid order.

9. For t he aforesaid reasons, t he writ pet it ion allowed. I m pugned order is set aside.
