The present Applicat ion has been filed by t he applicant s seeking ant icipat ory bail in Case Crim e No. 284 of 2025, regist ered at Police St at ion Jhabrera, Dist rict Haridwar under Sect ion 3, Sect ion 5 read wit h Sect ion 11 of t he Ut t arakhand Prot ect ion of Cow Progeny Act , 2007. 2 . The First Ant icipat ory Bail Applicat ion ( No.1089 of 2025) was dism issed as wit hdrawn on

24.09.2025 grant ing libert y t o t he applicant s t o file afresh. 3 . According t o t he First I nform at ion Report 1 dat ed 18.09.2025, a secret inform at ion was received by t he police on 17.09.2025 t hat Chot u, Farm an, Lalla, Sam ad, Tazim ( applicant s) , Saj id and I rfan are slaught ering cows in a poplar field. The police raided t he spot and recovered 190 kg. beef and ot her art icles from t he spot . One co- accused Saj id was arrest ed. He t old t he police t hat t he applicant s were involved in slaught ering cows, who fled from t he spot aft er seeing t hem ( police) . 4 . Heard Mr. Mohd. Safdar, learned counsel for t he applicant s and Mr. Prat iroop Pandey, learned Assist ant Governm ent Advocat e for t he respondent . 5 . Mr. Mohd. Safdar, Advocat e, subm it t ed t hat t he applicant s have been falsely im plicat ed in t he present m at t er. They were not present on t he spot . Apart from t he st at em ent s of t he arrest ed accused, no ot her evidence has been found against t he applicant s. Applicant s are not convict ed persons. They are perm anent resident s of Dist rict Haridwar, t herefore, t here is no possibilit y of t heir absconding. 6 . Mr. Prat iroop Pandey, learned Assist ant Governm ent Advocat e, has opposed t he ant icipat ory bail applicat ion orally. 2 7 . Personal libert y under Art icle 21 of t he Const it ut ion of I ndia is very precious fundam ent al right it should be curt ailed only when it becom es im perat ive according t o t he peculiar fact s and circum st ances of t he case. 8 . Having heard t he subm issions of learned counsel for t he part ies and keeping in view of t he fact s and circum st ances of t he case, wit hout com m ent ing on t he m erit s of t he case, t he present Applicat ion, filed for ant icipat ory bail, is allowed. I t is direct ed t hat in t he event of arrest of t he applicant s Taj am m ul alias Chot u, Farm an, Lukm an alias Lalla, Sam ad and Tazim , t hey shall be released on ant icipat ory bail on execut ing a personal bond of Rs. 30,000/ - and t wo reliable suret ies, each of t he like am ount , by each one of t hem , t o t he sat isfact ion of t he Arrest ing Officer, subj ect t o t he following condit ions: - ( i) Applicant s cooperat e wit h t he I nvest igat ing Agency and t hey shall m ake t hem selves available for int errogat ion by a police officer as and when required; ( ii) I f t he charge- sheet is filed, t he applicant s shall at t end t he t rial court regularly and t hey shall not seek any unnecessary adj ournm ent ; 3 ( iii) Applicant s shall not direct ly or indirect ly m ake any inducem ent , t hreat or prom ise t o any person, acquaint ed wit h t he fact s of t his case; ( iv) Applicant s shall not leave t he count ry wit hout t he previous perm ission of t he t rial court . 9 .
