Count er affidavit has been filed by t he St at e t hat som e of t he pet it ioners have already been regularized and para 6 of t he count er affidavit it has been st at ed t hat only t hose em ployees are being paid m inim um only who are wit hin t he am bit regularizat ion. The m at t er cam e up before t he Allahabad High Court in t he case in of Put t i Lal report ed in St a t e o f U.P. a n d o t h e r s Vs Pu t t i La l - ( 1 9 9 8 ) 1 U.P.L.B.E.C. 3 1 3 . Writ pet it ions were decided direct ing for fram ing t he rules for regularizat ion. The observat ions are quot ed below: “ I n pursuance of t he direct ions issued by t his Court pending t hese cases t he Governm ent of U.P. subm it t ed m ore t han one Schem e regularizat ion of t he pet it ioners, t hose Schem es hardly cont ain any hope for t heir regularizat ion. I t has been st at ed t herein t hat t he pet it ioners can be considered regularizat ion against available vacancies aft er am ending service rules. Available vacancies being few no subst ant ial help can be expect ed t hem . That apart , t he Governm ent fram ing t hose Schem es has not applied it s m ind t o t he quest ions dealt wit h herein above. These are aspect s which are t o be considered by t he Governm ent before fram ing Schem e for absorpt ion of t he pet it ioners. I n t he present t he appropriat e pleadings are also not t here so as t o declare t he em ploym ent of t he pet it ioners as daily wager for considerable long period as “ unfair labour pract ice” . We , are , t herefore, not expressing and 11 final opinion on t his quest ion also. The quest ions dealt wit h herein above are t o be considered and decided by t he Governm ent before fram ing t he Schem e regularisat ion/ absorpt ion t he pet it ioners and ot her sim ilarly placed em ployees. For t he reasons given above, t hese writ pet it ions and t he Appeals are part ly allowed. The j udgm ent s im pugned in t he Appeals are set - aside. The Governm ent of U.P. is direct ed t o appoint a Com m it t ee consist ing of Secret aries of Finance and Forest Depart m ent s and t he Legal Rem em brance or t heir nom inees wit hin a m ont h of product ion of cert ified copy of t his j udgm ent before t he Secret ary Forest Depart m ent , Ut t ar Pradesh. The Com m it t ee t o appoint ed w ill consider t he quest ion of fram ing Schem e regularizat ion/ absorpt ion t he pet it ioners and ot her sim ilarly placed em ployees working in t he Forest Depart m ent and t he Schem es undert aken by t he said Depart m ent . The com m it t ee will pass speaking order and will subm it it s report wit hin a period of t hree m ont hs of t he dat e of it s const it ut ion by t he Governm ent . I t will be open t o t he Associat ion Union of t he pet it ioners t o m ake represent at ion cont aining all t heir grievances in t his regard before t he Com m it t ee and such a represent at ion is m ade t he sam e shall also be decided by speaking order by t he said Com m it t ee wit hin t he sam e t im e specified above. The Governm ent will t hereaft er pass appropriat e order t aking int o considerat ion t he report t he Com m it t ee and m at erial available on t he record, wit hin one m ont h of t he receipt of t he report of t he 12 Com m it t ee. The whole exercise by t he Com m it t ee as well as by t he Governm ent should be com plet ed wit hin six m ont hs t he dat e of product ion of cert ified t his j udgm ent before t he Governm ent . Till t hen t he part ies shall m aint ain st at us quo.” However, t he m at t er went t o t he Apex Court and t he Apex Court has also direct ed for fram ing t he schem e for daily wagers. The word ‘m inim um pay’ has also been considered for daily rat ed workm en in t he case of St a t e o f U.P. Vs. Pu t t i La s 2 0 0 2 ( 1 ) E.L.C.5 2 4 ( SC) where it has been observed as under: “ I n several cases t his Court applying t he principal of equal pay for equal work has held t hat a daily wager, if he is discharging t he sim ilar dut ies as t hose t he regular em ploym ent t he Governm ent , should at least be ent it led t o receive t he m inim um of t he pay scale t hough he m ight not be ent it led t o any increm ent or any ot her allowance t hat is perm issible t o his count er part t he Governm ent .” I n t he m eant im e t he Ut t aranchal Governm ent int roduced t he Ut t aranchal Forest Depart m ent Regularisat ion ( On Group ‘D” Post s) of Daily Wages Appoint m ent Rules, 2003 and t he Rules having been fram ed wit h t he cut of dat e 1991. The said Rules are quot ed below: “ Re g u l a t i o n o f d a i l y w a g e s a p p o i n t m e n t o n Gr o u p “ D ” Po st s: ( 1) Any person who: 13 ( a) was direct ly appoint ed on daily wages basis on a Group “ D” post in t he Forest Depart m ent Governm ent service before June 29, 1991 and in cont inuing in service as such on t he dat e of com m encem ent of t hese rules; and ( b) possessed requisit e qualificat ion prescribed regular appoint m ent for t hat post at t he t im e of such appoint m ent on daily wage basis t he relevant service rules, shall be considered regular appoint m ent perm anent t em porary vacancy, as m ay be available in t he Forest Depart m ent in Group “ D” post , on t he dat e of com m encem ent of t hese rules on t he basis of his record and suit abilit y before any regular appoint m ent m ade in such vacancy in accordance wit h t he relevant service rules or orders. 6 - A p p o i n t m e n t b e d e e m e d t o b e u n d e r , t h e r e l e v a n t se r v i ce r u l e s e t c.: Appoint m ent s m ade under t hese rules shall be deem ed to be appointm ents under the relevant service rules or orders, if any. 7 - Se n i o r i t y : ( 1) A person appoint ed under t hese rules shall be ent it led t o seniorit y t he dat e of appoint m ent aft er select ion for regularizat ion in accordance wit h 14 t hese rules and shall, in all cases be placed t he persons appoint ed in accordance wit h t he relevant service rules, or as t he case m ay be, t he regular prescribed procedure, prior t o t he appoint m ent of such persons under t hese rules. ( 2) I f t wo or m ore persons are appoint ed t oget her, t heir seniorit y int erse shall be det erm ined t he order m ent ioned in t he order of appoint m ent .” I n t he light of t he aforesaid rules as well as in t he light of t he j udgm ent of t he Apex Court , t he respondent s are direct ed t o pass appropriat e order s considering t he claim of t he pet it ioners regarding regularizat ion in accordance wit h law. I n t he m eant im e t he respondent s are direct ed t o pay m inim um of t he pay scale of t he pet it ioners in t he light of t he j udgm ent of t he Apex Court . The writ pet it ion is allowed. A writ of m andam us issued direct ing t he respondent s t o t he pass appropriat e orders considering t he claim of t he pet it ioners for regularizat ion in accordance wit h law.
