Heard Sri R. P. Nautiyal, learned counsel for the petitioner and learned standing counsel for respondents. By means of this writ petition, the petitioner has prayed for the issue of writ or direction in the nature of Mandamus commanding the respondents to give promotion on the post of Untrained Pharmacist in the pay scale of Rs. 4000‐6000 in the District Hospital, Gopeshwar, Chamoli. Briefly stated, the petitioner was appointed on the post of Nursing Assistant in the District Hospital, Gopeshwar, District (cid:150) Chamoli by Deputy Chief Health Officer, Chamoli vide order dated 12.05.1976. The post of Nursing Assistant was abolished and it was declared as dead Cadre by the Department. However, the petitioner is still working on the 2 post of Nursing Assistant in District Hospital, Gopeshwar, District Chamoli, which is a Class IV post in the department. Learned counsel for the petitioner has submitted that the petitioner is working as Pharmacist in District Hospital, Gopeshwar, Chamoli since 1980 (copy of which is annexed as Annexure No.

2 to the writ petition). According to the petitioner on 19.05.1981 respondent no. 4 directed to work on the post of Pharmacist in Police Hospital, Gopeshwar, Chamoli till 31.05.1981 or till the regular Pharmacist Sri Vashisth returned from his leave. Again on 15.01.2002 the petitioner has preferred a representation, when one Sri Santosh Kumar Thakur retired. On 05.03.2002, respondent no.

4 has informed that the post of Untrained Pharmacist is available in the Department after retirement of Sri Santosh Kumar Thakur. 5 representation of the petitioner may be considered in accordance with the Rules. Respondents are directed to pass appropriate order on the representation of the petitioner for appointment on the post of Untrained Pharmacist. Petitioner shall file representation within a period of two weeks and therefore, within a period of six weeks the respondents shall pass a reasoned order on the petitioner(cid:146)s representation from the date of production of the certified copy of the order. However, petitioner shall be permitted to work as Untrained Pharmacist till his representation is decided by the competent authority.
