Heard Sri Ramji Srivastava learned counsel for the petitioner and perused the record. The petition has been preferred under Article 227 of the Constitution of India with the prayer that the respondent no.1-Principal Judge, Family Court, Dehradun may be directed to expedite the disposal of the divorce suit pending since the year 2000. Valuable rights of the parties are involved in divorce suit and it is desirable that the case may be decided expeditiously so that the parties may settle in life to the marital dispute peacefully keeping in view the decision to be given by the competent court. Having gine through the copy of the order sheet, submission is being caused in the disposal of the suit at the instance of respondent no.2. considering this, the grievance of the petitioner need to be redressed so that the divorce suit may be decided expeditiously. the delay is force In view of above, the petitioner is decided in terms that the original suit no. 130/2002 Yogesh Kumar Vs. Smt. Saroj Bala under Section 13 of the Hindu Marriage Act, 1955 shall be respondent no.1 decided by expeditiously, preferably, within a period of three months from the date of receipt of the copy of this order.
