Learned Counsels t he pet it ioners subm it t hat pet it ioners are ready t o give undert aking before t he concerned Sub Divisional Magist rat e t hat t hey will neit her run Madarsa nor use t he expression ‘Madarsa’ in t he nam e of inst it ut ions/ Makt abs run by t hem t ill t he t im e t heir inst it ut ions are duly regist ered/ recognized by Ut t arkahand Madarsa Educat ion Board.

Having regard t o t he fact s circum st ances of t he case and also in view of t he undert aking given on behalf of pet it ioners t hrough t heir respect ive Counsel, writ pet it ions are disposed of by providing t hat t he prem ises/ buildings, which are being used by pet it ioners for running educat ional inst it ut ions shall be de- sealed subj ect t o pet it ioners giving undert aking in t he form of affidavit before t he concerned Sub Divisional Magist rat e t hat t hey will neit her run Madarsa nor use t he expression ‘Madarsa’ in t he nam e of inst it ut ions run by t hem t ill regist rat ion of t he concerned inst it ut ion wit h t he Madarsa Board and pet it ioners shall be perm it t ed t o 6 run Makt ab from t he prem ises in quest ion and no int erference wit h t he right t o run Makt ab will be m ade wit hout any aut horit y of law.
12. However, is m ade t hat pet it ioners fail t o abide by t he undert aking given by t hem or if t hey are found unaut horisedly using t he expression ‘Madarsa’ in t he nam e of inst it ut ion run t hem , t he aut horit ies shall be t o t ake necessary act ion against such pet it ioner.
