Adhikari, learned counsel for the applicant and Shri Amit Bhatt, learned A.G.A. for the State. Applicant- Bhajan Singh, who is in jail in connection with crime No. 537 of 2006, relating to offence punishable under Sections 304B, 120 I.P.C. and that of offence punishable under Section ¾ Dowry Prohibition Act, 1961., P.S. Kotwali, District- Uttarkashi, has sought his release on bail. There is specific allegation against the accused Jaswant Singh (husband of the deceased) that he killed his wife. The applicant is father-in-law of the deceased. It is argued that there is no specific allegation in the First Information Report, as to the role of the applicant in commission of the crime. Considering the facts and circumstances, without expressing any opinion as to the final merits of the case, the applicant Bhajan Singh be released on bail on executing personal bond and on furnishing two sureties, each like amount the satisfaction of Chief Judicial Magistrate, Uttarkahsi.
