Mr. M.S. Tyagi, Advocate for the petitioner. Mr. K.P. Upadhyay, learned Addl. Chief Standing Counsel for Uttarakhand. The matter pertains to year 1991, when a notification dated 14.09.1991 was issued under Section 4 A (2) of the U.P. Consolidation of Holdings Act, 1953. Now the petitioner is agitating after 17 years that the notification dated 14.09.1991 be quashed. It is settled position of law that Court will not come for rescue for those who sleep over their right. Admittedly, there is inordinate delay in filing of the present writ petition therefore, no interference is called for from this Court. The writ petition is dismissed on the ground of latches. No order as to costs. However, it is open for the petitioner to pursue remedy before the State Authority by moving representation. (Sudhanshu Dhulia, J.)
