By the present writ petition, the petitioners have prayed for a writ of mandamus directing the respondents to consider the candidature of the Petitioners as Siksha Mitra or give preference under Siksha Mitra Scheme in Primary School of Naugaon Block. Briefly stated, Petitioners No. 1 &2 were initially appointed an Anudeshak by the respondent No.3 in the year 1992 under the scheme issued by the then U.P. Government in the year 1997 & petitioner No. 3 was also appointed an Anudeshak by respondent No. 3 under the above said scheme. They continued till 09.03.2000 as Anudehsak at Block-Naugaon District Uttarkashi. Petitioners have further submitted that in the year 1975, the then U.P. Government created a new Scheme “Anopcharick Siksha” according to which instructor Anopcharick will be given appointment for every Gram Shabha for giving basic education to the students of rural area who cannot go to school for receiving the primary education. After the creation of State of Uttaranchal, the Anopcharick Siksha Scheme has been abolished by the State of Uttaranchal and created a new scheme namely Sarva Siksha Abhiyan and the service of Anudeshak in all over State were terminated and they were assured that in newly created scheme they will be adjusted but till date inspite of such assurance the respondents have not adjusted the present petitioners. In the year 2001, the State of Uttaranchal issued a Scheme of Siksha Mitra, this was amended in year 2004 & 2005. According to this scheme such candidates who posses graduate degree and are the domicile of Uttaranchal and are residing in that Gram Shabha of Gram Panchayat or block will be considered for appointment as Siksha Mitra and State of Uttaranchal has appointed hundreds of Siksha Mitra but the services of Anudeshak who were removed on the basis of abolition of old scheme and creating of new scheme have not been regularized. Moreover, no preference has been given to the Anudeshak who were removed due to the creation of new Scheme known as Siksha Mitra. In this regard, Petitioners have approached the concerned authorities but all in vain. The petitioners are residing in Naugaon block and have domicile also and further several seats are lying vacant in many Primary Schools. The petitioners have preferred the writ petition No. 1740 (S/S) of 2005 (Smt. Chandra Kala Vs. State of Uttaranchal and others) which has been finally disposed of by this Hon’ble Court on
25.11.2005 on the same terms and conditions of the order by this Court on 14.09.2005 in Writ Petition No.1678(S/S) 2003 [Km. Seema Chamola and others Vs.
