Mr. Deep Chandra Joshi, Advocate for the applicant. Mr. V.S. Rawat, A.G.A. for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant is in judicial custody in Sessions Trial No.5 of 2021, arising out of FIR No.429 of 2020, under Sections 342, 504, 302 read with Section 34 IPC, Police Station Kashipur, District Udham Singh Nagar. He has sought his release on bail.
Heard learned counsel for the parties and perused.
This is the fourth bail application. The first bail application, being BA1 No.1569 of 2021, was rejected on
01.07.2022. The second bail application, being BA2 No.168 of 2023, was dismissed as withdrawn on 01.09.2023. The third bail application, being BA3 No.25 of 2024, was dismissed on 01.07.2024.
It is argued by learned counsel for the applicant that the applicant was arrested on 09.09.2020; almost he 2 has been in custody for 5 years; out of 35 witnesses, till date, only 10 witnesses have been examined; there are less chances of trial being concluded in near future.
Learned State Counsel admits these facts. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.

The bail application is allowed.
Let the applicant be released on bail, on her executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the court concerned. Ravi Bisht (Ravindra Maithani, J) 02.07.2025
