5. petitioner on bail by separate orders in 105 cases and in one case i.e. in relation to Case Crime No.329 of 2018 Co-ordinate Bench of this Court has granted bail to the petitioner by order dated 01.12.2023 in First Bail Application No. 2546 of 2023.

6. Learned counsel for the petitioner submits that the petitioner was the salaried employee and she resigned much earlier from the firm in the year 2017 and she is unable to arrange separate sureties for all the cases.

Mr. Deepak Bisht, learned Deputy Advocate General for the State submits that in relation to Case Crime No.329 of 2018, wherein the present petitioner has been implicated for the offence under Section 2/3 of Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, Co-ordinate Bench of this Court granted bail to the petitioner and therefore, seeking common sureties including Case Crime No.329 of 2018 amounts to seeking modification of the order dated 01.12.2023 passed by Co-ordinate Bench of this Court in First Bail Application No.2546 of 2023.

In response to this, learned counsel for the petitioner confined his relief only in respect of the cases mentioned in relief clause except the case in relation to Case Crime No. 329 of 2018 and submits in remaining cases, the petitioner may be permitted to furnish common sureties. He further submits that in relation to Case Crime No.329 of 2018, the petitioner will abide by the terms and 4 conditions as stipulated by this Court in the order dated 01.12.2023.

For submitting common sureties in respect of all the cases, in which the petitioner has been directed to be released on bail, the learned counsel for the petitioner placed reliance upon a judgment rendered by the Hon’ble Supreme Court in the case of Hani Nishad @ Mohammad Imran @ Vikky Vs. The State of Uttar Pradesh decided on 29.10.2018 in Special Leave to Appeal(Crl.) No(s). 8914-8915 of 2018. He submits that since the petitioner is involved in all the cases as mentioned in relief clause, the petitioner be permitted to execute a personal bond and two common sureties. Mr. Deepak Bisht, learned Deputy Advocate General for the State has no objection on this.

After hearing the arguments of the learned counsel for parties, the petitioner is permitted to execute a personal bond of Rs. 1,00,000/- (Rupees One Lakh Only) and the same bond shall hold good for all the cases as mentioned in relief clause along with two sureties of the like amount, which shall also hold good for all the cases in relief clause except the case in relation to Case Crime No. 329 of 2018.
