1. Since t hese t wo writ pet it ions involve com m on quest ions of law and fact , t hey were heard t oget her and are being decided by t his com m on j udgm ent . However, for t he sake of brevit y, fact s of Writ Pet it ion ( S/ B) No. 470 of 2014 alone, are being considered and discussed.

2. Pet it ioner part icipat ed in a select ion held by Ut t arakhand Public Service Com m ission for t he post of Assist ant Professor ( Hist ory) . Since pet it ioner was not select ed, t herefore he filed t his writ pet it ion in 2014, seeking following reliefs: - “ ( i) I ssue a w rit , order or direct ion in t he nat ure of quashing t he line of Clause 5 ( Ga) m ent ioned as " िविजिटंग लै�रर / अंशकािलक ्ቚव�ा के �प म� काय�रत् अ�िथ�यों को परी�ा / सा�ा�ार म� उनके �ारा ्ቚा� कुल अंकों के अिधकतम 10 ्ቚितशत बोनस अंक िदये जाय�गे। The English version is her e: - ( The Visit ing Lect ur er/ Part - t im e Lect urer will be given m axim um 10% m ark s) . ( ii) I ssue a w rit , order or direct ion in t he nat ure of quashing t he result dat ed 26- 06- 2014 of Hist or y subj ect concerned t o t he privat e r espondent no. 4. 1 ( iii) I ssue a writ , order or direct ion in t he nat ure of Mandam us direct ing t he respondent no. 1, 2 and 3 t o rect ify t he anom aly of select ion process of Hist ory subj ect t hat is concern t o t he pet it ioner in regard t o awarding 10% bonus m ark t o t he pet it ioner as Higher Educat ion Am ended Rules 2011 of 9 ( Gha) & 9 ( Cha) and also as per adv ert isem ent No. 04/ D.R./ Degree/ Sewa- 2/ 2011- 12/ dat ed 04- 12- 2011. ( iv) I ssue a writ , order or direct ion in t he nat ure of Mandam us direct ing t he r espondent no. 3 t o award t he 10% bonus m ar k t o t he pet it ioner in t he select ion process of Hist ory subj ect held on 13- 01- 2014 t o 15- 01- 2014 so far concerned t o t he pet it ioner and declare t he r esult of Hist ory subj ect awarding t he concern effect ed respondent no. 4 and furt her prayed t o sum m on t he record/ broad- sheet of t he I nt erview Board. t he proper opport unit y t o ( v) I ssue a w rit , order or direct ion in t he nat ure of Mandam us direct ing t he r espondent nos. 1 t o 3 t o r esolve t he cont r ov er sy adj ust ing t he pet it ioner on t he vacant post of Hist or y as a r egular facult y/ Assist ant Professor s of Hist ory subj ect .”

Mr. Pankaj Miglani, learned counsel appearing for Ut t arakhand Public Service Com m ission subm it s t hat ident ical issue was decided by coordinat e Bench of t his Court in Writ Pet it ion ( S/ B) No. 469 of 2014 in which reliefs sought were also ident ical. He has produced copy of t he j udgm ent dat ed 24.04.2025, rendered in t he said writ pet it ion.

4. Upon perusal of t he j udgm ent , we find subst ance in t he subm ission m ade by learned counsel t he Ut t arakhand Public Service Com m ission t hat t he issue involved in t hat writ pet it ion was ident ical.
