By means of this petition moved under section 482 of Code of Criminal Procedure, 1973 (for short Cr.P.C.) the petitioner has sought quashing of the proceedings of criminal case no. 7 of 2011, State vs. Himmat Singh Aithani, relating to offence punishable under section 135 Electricity Act, 2003, pending in the court of Sessions Judge, Bageshwar. Having considered submissions of learned counsel for the parties, considering the nature of offence, and after going through the papers on record, this Court is not inclined to interfere with the trial of the case in its jurisdiction under section 482 Cr.P.C.. The petition under section 482 Cr.P.C.,is dismissed summarily with the observation that if the petitioner Himmat Singh Aithani surrenders before the court concerned his bail application shall be heard and disposed of without unreasonable delay.
