Counsel for the Petitioner : Mr. Neeraj Garg, Advocate with Mr. Pankaj Kumar, Advocate. Counsel for the Respondent: Mr. Sagar Kothari, Nos.1 & 2. Advocate. Hon’ble Alok Kumar Verma,J. This writ petition has been filed under Article 227 of the Constitution of India with the following prayers :-

(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 22- 04-2025, passed by learned District Judge, Dehradun on stay application of respondent no. 1 and 2 in Civil Revision No. 74 of 2025, Manendra Singh & another Vs. Sardar Amarjeet Singh & others (Annexure No. 1 to the writ petition). (ii) Any other order or direction which this Hon'ble court deems facts and fit and proper circumstances of the case, be passed. (iii) To award cost of the petition to the Petitioner.

The Amendment Application (IA No.2 of 2026), filed by the petitioner, is taken on record.

Heard Mr. Neeraj Garg, learned counsel 1 appearing for the petitioner and Mr. Sagar Kothari, learned counsel respondent nos.1 & 2/judgment-debtors.

The respondent nos.3 to 9 are the proforma respondents.

The petitioner has sought the following alternative prayer through the Amendment Application (IA No.2 of 2026).

(aa) Issue a writ, order or direction, directing court of learned 3rd Additional District Judge, Dehradun to decide in accordance with law Civil Revision No. 74 of 2025, Manendra Singh & another Vs. Sardar Amarjeet Singh Wadhwa & others on the next date fixed i.e. 15-04-2026 or within further stipulated period, which this Hon'ble facts and fit and proper Court deem circumstances of the case.

Mr. Neeraj Garg, Advocate, on instructions, has requested to decide the present writ petition by directing the court concerned to decide the civil revision at the earliest.

The said request has not been opposed by Mr. Sagar Kothari, Advocate.

On the request of both the parties, the present writ petition is disposed of directing the learned IIIrd Additional District Judge, Dehradun to decide the Civil Revision No.74 of 2025, “Manendra Singh and Another vs. Sardar Amarjeet Singh Wadhwa and 2 Others”, on the date fixed i.e.20.05.2026 and if due to any cogent reason, the civil revision is not decided on

20.05.2026, the said Civil Revision shall be decided within a period of one month, as per law, thereafter.

Mr. Neeraj Garg, Advocate has sought two days’ time to file an amended memo of prayer clause.
