1. This I nt ra- Court appeal is filed by writ pet it ioner, challenging t he j udgm ent and order dat ed 19.09.2016, passed by learned Single Judge in Writ Pet it ion ( S/ S) No. 1292 of 2012. By t he said j udgm ent , his challenge t o order of t erm inat ion was repelled and his prayer for writ of m andam us t o t he aut horit ies t o give com pensat ion t o pet it ioner for unlawful act ion of respondent of engaging him as PTA t eacher, was t urned down, writ pet it ion was dism issed wit h direct ion t o Managing Com m it t ee, t o im m ediat ely not ify t he exist ing vacant t eaching post s t o Dist rict Educat ion Aut horit ies, appoint m ent against t hem . for m aking select ion regular

Appellant has challenged t he said j udgm ent on t he ground t hat t he provision cont ained in Sect ions 40 and 41 of Ut t arakhand School Educat ion Act , 2006, which provide for cert ain benefit t o PTA t eachers, were not considered. Sect ion 41 of Ut t arakhand School 1 Educat ion Act , 2006 is reproduced below: - o f h o c Pa r t a p p o i n t m e n t “ 4 1 . A d Ti m e Te a ch e r / A ct i n g P.T.A . Provision reproduced below: - cont ained in Sect ion 40( 1) ( a) ( iii) “ [ ( i i i ) w a s a p p o i n t e d o n a d h o c b a si s i n l e ct u r e r g r a d e o r t r a i n e d g r a d u a t e g r a d e o n o r a f t e r 2 6 i n Ja n u a r y , 2 0 1 0 a g a i n st su b st a n t i v e v a ca n cy a cco r d a n ce w i t h t h e p r o v i si o n s o f Se ct i o n 4 0 o f t h e Ut t a r a k h a n d Sch o o l Ed u ca t i o n A ct , 2 0 0 6 a n d h o l d p r e scr i b e d q u a l i f i ca t i o n a n d e l i g i b i l i t y a g a i n st t h e p o st .] ”

3. Learned counsel for appellant subm it s t hat PTA t eachers, who were given cert ain benefit s under Sect ions 41 and 40 of Ut t arakhand School Educat ion Act , 2006, would be denuded of such st at ut ory benefit s, if t he im pugned j udgm ent is not set aside.

4. He furt her subm it s t hat im pugned j udgm ent was rendered by learned Single Judge wit hout considering im port of t he t he aforesaid st at ut ory provision; t herefore, t he sam e is unsust ainable in t he eyes of law.

5. We find subst ance t he said subm ission. A benefit which st at ut e has provided t o PTA t eachers cannot be t aken away wit hout considering and dealing wit h relevant st at ut ory provisions. I n t he im pugned 2 j udgm ent , t here is no discussion regarding Sect ions 40 and 41 of Ut t arakhand School Educat ion Act , 2006, t herefore, general direct ion issued t o Managem ent Com m it t ee t o supply all vacancies, including t hose held by PTA t eachers, by regular select ion, would not be proper. I n such view of t he m at t er, t he Appeal is allowed

6. and t he im pugned j udgm ent is set aside.

The writ pet it ioner/ appellant shall be ent it led t o benefit of provisions cont ained in Sect ion 40 and 41 of Ut t arakhand School Educat ion Act , 2006 only if he is appoint ed as PTA t eacher against a sanct ioned vacant post before t he cut- off dat e, fixed by St at e Governm ent and he is being paid rem unerat ion as Ad- hoc t eacher from public exchequer.
