Act ing as per order dat ed 20.04.2017, t he respondent no.3, t hrough his let t er dat ed 25.05.2017 ( Annexure No.13 t o t he writ pet it ion) , direct ed t he Manager, K.L.D.A.V. I nt er College, Roorkee t o lodge an FI R against t he pet it ioner. 2 . The present writ pet it ion has been filed under Art icle 226 of t he Const it ut ion of I ndia wit h t he following prayers: - 1 I ssue a writ , order or direct ion t o quash t he “ ( i) im pugned order dat ed 20.04.2017 passed by t he respondent no.1 in appeal no.22629 of 2016, Shri Raj kum ar @ Teet u v. Public I nform at ion Officer & anot her ( cont ained as Annexure No.11 t o t his writ pet it ion) . ( ii) I ssue a writ , order or direct ion t o quash t he order/ let t er dat ed 25.05.2017 issued by t he respondent no.3 t o t he Manager, K.L.D.A.V. I nt er College Roorkee ( cont ained as Annexure No.13 t o t his writ pet it ion) . ( iii) I ssue a writ , order or direct ion in t he nat ure m andam us com m anding/ direct ing t he respondent nos.1 t o 3 not t o lodge FI R against t he pet it ioner on t he basis of order dat ed 20.04.2017 passed by t he respondent no.1 and furt her not t o init iat e any proceedings t o t erm inat e t he services of t he pet it ioner. ( iv) I ssue any ot her relief, which t his Hon’ble Court m ay deem fit and proper t he circum st ances of t he case be passed in favour of t he pet it ioner. ( v) Cost of t he pet it ion be awarded in favour of t he pet it ioner.” 3 . Heard Mr. Tapan Singh, learned counsel for pet it ioner and Mr. K.S. Meht a, learned Addit ional Chief St anding Counsel for St at e. 4 . Mr. Tapan Singh, Advocat e, has relied on an order dat ed 04.01.2018, passed by t he coordinat e 2 Bench of t his Court in WPMS No.531 of 2011. The relevant port ion of t he order of t he coordinat e Bench is reproduced hereunder: - “ Pet it ioner is aggrieved by t he order dat ed

05.04.2011, whereby t he St at e I nform at ion Com m issioner has ordered t he regist rat ion of FI R against t he pet it ioner. There is no provision in t he Right t o I nform at ion Act , 2005, giving j urisdict ion t o t he St at e I nform at ion Com m issioner t o order regist rat ion of FI R. The St at e I nform at ion Com m issioner exceeded his j urisdict ion/ aut horit y by order t he regist rat ion of FI R. Accordingly, t he writ pet it ion is allowed. I m pugned order dat ed 05.04.2011 is quashed and set- aside.” 5 . Mr. Tapan Singh, Advocat e, request ed t o decide t he present writ pet it ion in t he light of t he said order dat ed 04.01.2018. 6 . Mr. K.S. Meht a, learned Addit ional C.S.C., on inst ruct ions, subm it t ed t hat t he said order dat ed

I n view of t he above, t he im pugned order dat ed 20.04.2017, passed by t he Ut t arakhand I nform at ion Com m issioner, Dehradun, regarding t he direct ion t o lodge t he FI R, and t he inst ruct ions dat ed 3 25.05.2017, issued by t he respondent no.3, t he Chief Educat ion Officer, Haridwar, regarding lodging FI R in com pliance wit h t he order dat ed 20.04.2017, are quashed and set aside. 8 . The present Writ Pet it ion ( M/ S No.1548 of 2017) is disposed of accordingly. 9 . I t is m ade clear t hat t he respondent s would be free t o t ake act ion in t he m at t er, if requires, but , as per t he law.
