Present applicant- Sarbj eet Singh @ Chabba, S/ o Kulwinder Singh is praying for regular bail in relat ion t o FI R dat ed 03.01.2025, regist ered as FI R No. 007 of 2025 at P.S. Bazpur Dist rict Udham present Singh Nagar wherein applicant has been im plicat ed for t he offences under Sect ions punishable 109( 1) and 351 ( 3) of BNS 2023. Brief fact s, of t he case, are t hat t he 4. applicant real brot her of Ms. Mandeep Kaur who m arried wit h one Navj ot Singh on 09.03.2023. An FI R was lodged by one Sarvj eet Kaur, m ot her of Navj ot Singh, who is t he husband of t he sist er of t he present applicant . As per t he FI R, t he applicant was not happy wit h t here was a t hreat t o Mandeep Kaur and her husband regarding which t he prot ect ion was also sought from t he police, and, t hereaft er t his Court seeking t hey approached prot ect ion and t hereaft er prot ect ion was given. Thereaft er, incident was happened on 12.01.2025 by which t he applicant by way of rash and negligent driving hit t he m ot orcycle of Navj ot Singh. 5. The allegat ion was t hat t he said at t em pt was done wit h an int ent ion t o kill Navj ot Singh. Consequent ly, aft er t he applicant was lodging t his m arriage and t he FI R, t he arrest ed on 08.01.2025 and aft er invest igat ion charge sheet has been filed. 6. On 25.03.2025, t he sist er of t he applicant , nam ely, Ms. Mandeep Kaur and her husband Navj ot Singh j oined t he proceedings t hrough V.C. Bot h of t hem inform ed t his Court t hat t here is a t hreat percept ion from t he side of t he present applicant and t he fat her also. 7. Mr. Adit ya Singh, learned counsel who appears for t he applicant subm it s t he present applicant and his t hat brot her Harpreet Singh and fat her Kulwinder Singh have no such int ent ion and t hey all are agreed t o accept t heir t his assurance m arriage happily. On m at t er was post ed for t oday. 8. Today, again Ms. Mandeep Kaur and t he her husband Navj ot Singh j oined proceeding t hrough V.C. and apprise t his Court t hat fat her of Ms. Mandeep Kaur as well as her younger brot her Harpreet Singh and m ot her visit ed t heir house and all of t hem had lunch t oget her and t hey happily accept t heir m arriage. This Court furt her int eract wit h t he younger brot her Manpreet Singh, Ms. Mandeep Kaur and Navj ot Singh, who appears t hrough V.C. and t hey all appears t o be happy and Ms. Mandeep Kaur and her husband subm it s t hat now t here is no t hreat percept ion. 9. t heir disput es am icably. 10. Mr. Bisht , learned A.G.A. subm it s t hat since, prim a facie, it appears t hat t he part ies have resolved t heir disput e, t herefore, t here is no purpose t o keep t he present applicant in j ail, part icularly when t he charge sheet has been filed. He fairly subm it s t hat if t he part ies have set t led t heir disput e t hey can furt her go for com pounding of t he offences. 11. The suggest ion, as given by t he really appreciable, learned A.G.A. I t appears now t he part ies who are, fact , close relat ives have resolved j oined t hrough V.C. and t he part ies have part icularly when set t led t heir disput e and t he vict im s of t he FI R also subm it s t hat now at t his j unct ure t here is no t hreat percept ion. 12. Aft er hearing t he argum ent s of t he learned counsel t he part ies and furt her t aking int o considerat ion t he fact t hat since now t he part ies have set t led t heir disput es am icably and t oday bot h t he vict im Ms. Mandeep Kaur and her t he husband Navj ot Singh proceedings t he younger brot her Manpreet Singh who is int eract ion in Court on also present subm it s fam ily t hat he and his all m em bers happily accept t heir m arriage, t his Court is of t he view t hat t he present applicant deserves for bail. 13.
