By this application filed under Order XLI Rule 3-A of CPC the appellant-petitioners prayed for condoning the delay of 107 days in preferring RSA No.61 of 2012 challenging the judgment and decree dated 21.04.2012 passed by learned District Judge, North Tripura, Kailashahar, in Title Appeal No.09 of 2010. The reason for the delay has been assigned by the appellant-petitioners in paragraphs 3, 4, 5 and 6, which is supported by affidavit. No written objection filed on behalf of the respondents. Learned senior counsel, Mr. Chakraborty fairly submits that delay may be condoned subject to payment of some cost. I am satisfied with the reason assigned and, hence the delay is condoned subject to payment of a cost of `500/-(rupees five hundred). CM Application accordingly stands disposed of.
