Bhattacharjee, learned counsel appearing for the applicant and Mr. Ratan Datta, learned Public Prosecutor appearing for the State. This is an application under Section 439 of Cr.P.C. for grant of bail filed by the applicant Shri Gouranga Datta on behalf of accused Shri Suman Datta arrested on 08.04.2022 in connection with Baikhora P.S. case No.2022/BKR/010 under Sections 20(b)(ii)(C)/25/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. Learned counsel for the applicant drew the attention of this Court to an order dated 20.04.2022 whereby the bail application of accused Suman Datta came to be rejected in view of pendency of investigation. Learned counsel for the applicant further submitted that several other applications have been moved from time to time but all have been turned down. Learned Public Prosecutor appearing for the State, on the other hand, submitted that in the case at hand charge-sheet has been submitted against all accused persons on 30.06.2022. Since charge-sheet has already been submitted, the present bail application is permitted to be withdrawn with liberty to move a fresh bail application before the learned trial Court and if such an application is filed, the learned trial Court would do well to consider the same expeditiously on its own merit in accordance with law. The copy of the charge-sheet submitted by the learned Public Prosecutor shall be kept on record. Bail application stands disposed of as withdrawn. (INDRAJIT MAHANTY), CJ Pulak
