HON'BLE MR.JUSTICE MOHAMMAD RAFIQ HON'BLE DR. JUSTICE MRS. MEENA V GOMBER Shri Rajneesh Gupta for the appellant. Shri J.R. Bijarniya, PP for State. Shri Ram Dayal, I.O. present in person. ****** Shri Ram Dayal, I.O. is present in person and submits that one of the accused Udai Singh has been arrested on production warrant. In his interrogation, it is transpired that the abducted niece of petitioner is with Mohan, who is said to be at Ujaain. He further submits that he himself along with the police party will go tomorrow at Ujjain to nab the culprit and recover Kumari Suman, who is said to be minor. In the facts of the case, we direct that the Magistrate having jurisdiction of the FIR in question shall supervise the investigation of the said FIR. The I.O. shall appear before the Magistrate with the report of investigation on
04.01.2013 and thereafter on every fortnight as per dates fixed by him. The Magistrate concerned shall be entitled to summon the Superintendent of Police or, if necessary, even the Inspector General of Police to enforce his order for restoration of the custody of Kumari Suman to her parents or to any person who is lawfully entitled to her custody. With that direction, the petition is disposed of. However, if the petitioner is not satisfied with the order passed by the Magistrate, he will have his remedy against his order under the Code of Criminal Procedure. (DR.MEENA V GOMBER),J.
