JUSTICE SAMEER JAIN Order 04/04/2025 Vide order dated 16.01.2025 passed in SBCWP No.13880/2024, categorical directions were spelled out for the registry to list the matters pertaining to old/stale recruitments/appointment processes before the Court. In compliance of the aforementioned directions registry has listed a bunch of matters before the Court under class Code 515 which pertain to recruitment and appointment. It is clarified that the present order qua the petitions herein and the petitions connected with the lead petition henceforth, the orders passed now onwards shall be treated as a part and parcel of the further orders and the judgment shall be made applicable on mutatis mutandis basis. Learned counsel for the respondent-State has apprised the Court with the fact that subsequent to the impugned recruitment(s), fresh recruitment processes have taken place, and as on date no seats are lying vacant (in majority of petitions), as per the relevant Rules moreover, the waiting list(s) has/have also lapsed. Therefore, the instant petition(s)/ a number of petitions from the instant bunch of matters have rendered infructuous. Learned counsel for the petitioners has refuted the aforementioned averments therefore, in the interest of justice, an (6 of 6) [CW-8574/2012] opportunity of 7 days is granted to the learned counsel for the petitioners to substantiate the contentions/refusal made by him/them, and place on record the relevant documents. Considering the ratio passed by the Hon’ble Supreme Court in Shankaran Dash Vs. Union of India reported in (1991) 3 SCC 47 and State of Orissa & Anr. Vs. Raj Kishore Nanda & Ors. reported in (2010) 6 SCC 777, this Court is of the view that if the aforementioned are not complied with, the instant petition(s) shall be dismissed as rendered infructuous.
