O R D E R S.B. CIVIL WRIT PETITION NO.10460/2011. Vikram Singh Meena Vs. State of Rajasthan & Ors. Date of Order:- March 6, 2012. HON'BLE MR.JUSTICE MOHAMMAD RAFIQ Shri Raj Kumar Goyal for the petitioner. ****** BY THE COURT:- This writ petition has been filed against the order of recovery for a sum of Rs.26,598/-. It is stated that petitioner got the work done as per the requirement. However, the road so constructed by the petitioner was inspected after two years, thus reduction of the size may be on account of rain, hence, recovery should not have been effected and at the same time factual postilion regarding two other aspects was also given b the petitioner in his representation, however, same was not considered, thus petitioner left with no option but to file this writ petition. I have considered the submissions made and perused the record carefully. All the issues raised in this writ petition need a finding of facts which otherwise cannot be viewed by this Court while exercising the jurisdiction under Article 226 of the Constitution of India. In view of the aforesaid, learned counsel for petitioner prays that he may be allowed to avail the 2 SBCWP No.10460/11. alternative remedy available with him. In view of statement made, this writ petition is dismissed. However, petitioner would be at liberty to avail the alternative remedy to challenge the order of recovery. (MOHAMMAD RAFIQ), J.
