Joshi with Mr. Sanjay Joshi, for the petitioner. **** Learned counsel for petitioner seeks permission to withdraw this habeas corpus petition with liberty to move an application under Section 97 of the Code of Criminal Procedure before the concerned Judicial Magistrate. Prayer appears to be reasonable and the same stands allowed. Habeas corpus petition is, accordingly, dismissed as withdrawn with liberty as prayed for. It is needless to mention that in case an application under Section 97 Cr.P.C. is filed before the concerned Magistrate, the said Court will pass necessary order immediately as per law.
