1. In compliance of the directions spelled out in the order dated 25.08.2025, parties have marked their appearance and have identified by their respective counsel.

2. Upon a query being put forth upon the parties as to whether they are desirous of entering into mediation proceedings to put quietus to the dispute inter se them, the parties have stoutly shown their disinterest and torment.

3. Upon interaction with the parties, it is deduced that the instant petition is filed assailing the impugned order dated

11.03.2024, passed by learned IAS, Presiding Officer, Appellate Tribunal, Collector and Zila Magistrate, Jaipur in case no. 58/2023 whereby the petitioners were directed to vacate the property wherein they were residing. [2025:RJ-JP:38388] (2 of 4) [CW-10182/2024]

4. The petitioners have contended that petitioner no. 1 is son and petitioner no. 2 is daughter-in-law of the respondent. It is submitted that petitioner no. 1 is a retired army official and as on date he along with his wife (petitioner no.2) and two daughters is is residing in Udaipur. They have submitted that in the property in question they also have made input with their hard earned money. However, no substantial documents are furnished to substantiate the said averment.

Contrary to the aforementioned, respondent who is a senior citizen aged approximately 80 years has submitted that he is in grave distress due to the actions and habits of the petitioners, as petitioner no. 1 is addicted to alcohol, who often calls his friends and create nuisance in name of get together and parties. It is further submitted that he has a constant threat from the petitioners, who at erstwhile occasions have attempted to enter into fist-fight with the respondent. Moreover, they have filed several suits and petitions to obtain the property and assets of the respondent.

During the course of interaction the respondents has also relied upon a rent agreement that was signed way back, qua the property in question and other documents, stating that he has faced prolonged litigation due to the ulterior motives of the petitioners. It is also apprised to the Court that as on date the respondent is living with his younger son and other family members in the property in question.

Having heard the submissions made by the parties and upon a perusal of the material available on record, this Court at the outset, keeping note of the significance of the objective of the [2025:RJ-JP:38388] (3 of 4) [CW-10182/2024] Maintenance and Welfare of Parents and Senior Citizens Act, 2007 i.e. to provide effective and legal maintenance and welfare to elderly parents and senior citizens who are unable to support themselves, ensuring their financial security, basic necessities like food, shelter, and medical care, and a life of dignity and respect and that it aims to discourage neglect and abandonment, establish legal recourse for seniors, protect their property rights, and reinforce the societal responsibility of children and relatives to care for their elders, is of the view that in circumstances where the children err to perform their duties, judicial intervention to safeguard the rights and life of the elderly citizens is vital.

It is also noted that petitioners, as on date, are living in Udaipur; that the petitioner no. 1 is retired from Armed Forces from which he is drawing pension, withal he is also into occupation at Udaipur; that the respondent has a threat to his life and personal liberty, due to the actions of the petitioners; that the Act of 2007 is sacrosanct statute, for consideration of issues pertaining to the senior citizens (in the matter at hand – respondent, who is aged approximately 80 years of age); that the factual aspect of the matter at hand, the differentiating opinions and conflicts inter-se the parties is already considered in the impugned order dated 11.03.2024; the relevant extract of which is reproduced herein below: “ अपीलारर ने यह अपील पसुत कर अधीनस अधधकरण के अपीलाधीन आदेश धदनांक 26.09.2023 को धनरस कर अपीलारर के साधमत की समधत मकान नमर 27, व 2 पतरर 1 कै लाशनगर गली नमर 18 झोटवाडा जयपुर से को बेदखल करने का अनुतोष चाहा है। धववाधदत समधत अपीलाधररया के साधमत की है। माता- धपता एवं वररष नागररक के जीवन एव उनके धहतों की सुरका करना का दाधयत अधधकरण का है। माता- धपता या [2025:RJ-JP:38388] (4 of 4) [CW-10182/2024] वररष नागररक की समधत की सुरका के धपता एवं वररष नागररकों का भरण पोषण धनयम 2010 है जो इस पकार है-" धकसी धलए माता- की धारा 20 (5) वररष नागररक के जीवन या समधत के धकसी खतरे की दशा मे धजला मधजस् ेट या समकरप से पाधधकृ त उसके अधीनस धकसी अधधकारी का ऐसे वररष नागररक के जीवन और समधत की सुरका करने का कतरव होगा।" अधीनस अधधकरण दारा अधधधनयम के पावधानों के तहत माता- धपता या वररष नागररक की मांग पर पुत व पुतवधु को मकान से बेदखल करने का आदेश धदया जा सकता है। इस समन मे समय- समय पर माननीय उच नायालय एवं माननीय सवरच नायालय दारा भी माता- धकये गये है। पतरर संखा 1 व 2 धपता व वररष नागररक के पक मे धनणरय पाररत को उक समधत से बेदखल धकये जाने का आदेश धदया जाना उधचत है। फलसरप अपील सीकार की जाती है अधीनस अधधकरण के अपीलाधीन आदेश धदनांक 26.09.2023 को अपास 27, धकया जाता है। अपीलारर के साधमत की समधत मकान नमर मकान नमर झोटवाडा जयपुर से पतरर संखा 1 व 2 को बेदखल करने का आदेश धदया जाता है। सार ही पतरर संखा 1 व 2 को कै लाश नगर गली नमर 18 अपीलारर से गाली गलौच व मारपीट नही ं करने हेतु पाबन धकया जाता है"

For the rationale noted herein above, the present petition is dismissed, as being bereft of any merits and for the reason that the order dated 11.03.2024 is passed after an assiduous consideration of material facts and relevant legal provisions. Pending applications, if any, shall stand disposed of.

10. The petitioners are directed to be evicted from the respondent’s property, house no. 27, Kailash Nagar, Jhotwara, Jaipur, while maintaining public order, within an upper limit of thirty days, from the date of passing of this order.

11. A copy of the present order be sent to the Sub- Divisional Magistrate, Jaipur City South, for compliance. Pooja /5 (SAMEER JAIN),J
