JUSTICE MAHESH CHANDRA SHARMA Mr. Ram Singh Rathore, counsel for the appellant Mr. RP Vijay, for the respondent no. 5 This appeal has been filed against the judgment and award passed by the Tribunal. Brief facts of the case are that the claimants filed the claim petition before the Tribunal with regard to death of Chawandraj in a road accident, which is said to have taken place on 2.6.2004. Thereafter notices were issued; reply was filed; certain issues were framed and after hearing all the parties, the learned Tribunal passed the aforesaid impugned judgment and award dated 2.11.2007, decreeing an amount of Rs. 3,76,000/- as compensation in favour of claimants and fastened the entire liability upon the appellant – The New India Assurance Co. Ltd. Being aggrieved by the aforesaid judgment and award passed by the Tribunal, this appeal has been filed by the New India Assurance Co. Ltd.. Learned counsel for the Insurance Co. 2 has contended that the Tribunal has committed error while passing the award not taking into consideration the oral as well as documentary evidence available on record. He has further contended that the Tribunal ought to have decided the petition on the basis of law of Workmen Compensation Act, 1923, but the learned Tribunal did not consider the pleadings of the appellant and awarded compensation contrary to Workmen Compensation Act. He has further contended that the Tribunal ought to have framed the issues and thereafter decided the claim petition, but the learned Tribunal has not followed the provisions of the Act. Hence, the impugned judgment and award passed by the Tribunal should be quashed and set-aside. On the other hand, learned counsel for the Oriental Insurance Co. has opposed the arguments of learned counsel for the appellant and contended that the Tribunal on the basis of material adduced before it, rightly passed the impugned judgment and award. Hence, no interference is required by this Court. I have heard learned counsel for the parties and carefully perused the relevant material on record. 3 Looking to the facts and circumstances of the case, the Tribunal is found to have dealt with each and every aspect of the matter ad-longum and rightly decided the matter. Hence, the appeal filed by the Insurance Co. being without any substance, is hereby dismissed after confirming the judgment and award passed by the Tribunal.
