The learned counsel Mr. Manish Sharma for the appellants and Mr. Alok Garg appearing for the respondents have submitted a joint application being No. 18193/12 signed by the respective parties, whereby the parties have arrived at an amicable settlement and the appellants-tenants have agreed to vacate the suit premises on 30th June, 2014, to which the respondent-landlord has no objection. The said application has been signed by all the respective parties and their respective advocates also. One of the appellant Kailash S/o Madan Gopal and the respondent Goverdhan Das are present SBCFA No. 686/09. SBCivil Misc. Appli. No.18193/12. Madan Golal & Ors. Vs. Goverdhan Das Rathi & Ors. 2 in the court and they have agreed to the terms of the settlement as mentioned in the application. The learned counsel Mr. Manish Sharma for the appellants also states that the appellants shall not transfer or submit or create any third party interest in the suit property and also pay the rent regularly till 30th June, 2014. In view of the said application, the learned counsel Mr. Manish Sharma for the appellants does not press the appeal and requested the court to dispose of the appeal accordingly.

In view of the above the appeal is permitted to be withdrawn as not pressed for in view of the settlement arrived at by the parties. The application and the appeal stand disposed of accordingly.
