HON’BLE MR.JUSTICE MOHAMMAD RAFIQ None present for the petitioner. **** This case was listed on 27/4/2007. Today also, no one has put in appearance on behalf of the petitioner. This writ petition has been filed with the prayer that the respondents be directed not to transfer Vehicle No.RJ- 14-2G-5846, which is in possession of the respondents, in favour of any other person other than the petitioner and return the same to her. 2 SBCWP NO.9424/2006. On perusal of the petition, I find that this writ petition has been filed against Megma Leasing Ltd., which is a private company and is not an instrumentality of State within the meaning of Article 12 of the Constitution. The vehicle in question appears to have purchased on Higher Purchase Agreement and the dispute is private in nature and this is not the proper forum for redressal of her grievance. The writ petition is dismissed being not maintainable however with the liberty to the petitioner to seek appropriate remedy. (MOHAMMAD RAFIQ), J.
