Mr.Sanjay Mehla, Public Prosecutor. ***** We have heard learned counsel for the parties and perused the reply submitted by the State along with the report of the Superintendent of Police, Bharatpur and the Social Welfare Department. Both the authority have not recommended the case of the petitioner for being released on first regular parole. In view of the reasons given by the Superintendent of Police, Bharatpur in paras 6 and 7 of the letter dated 01.05.2009, the application of the accused petitioner for release on first regular parole has rightly been rejected. However, the petitioner would be entitled to re-submit the application in accordance with law. No case for granting of parole is made out to at this stage.
