1. Petitioners, in both the writ petitions, are retired employees of Rajasthan State Industrial Development & Investment Corporation (RIICO) and have prayed to quash the Circular dated
31.05.2017 and claiming entitlement to get pension under the Employees’ Pension Scheme, 1995, in terms of judgment of the Hon’ble Supreme Court in case of R.C. Gupta Vs. Regional Provident Fund Commissioner, EPFO [(2018) 14 SCC 809]. [2025:RJ-JP:26166] (13 of 20) [CW-6498/2019]
2. Petitioners have come up with a case pleading inter alia that they are optee of pension under Employees’ Pension Scheme, 1995 and they should be paid pension on the basic of actual salary, instead of ceiling limit. In support of such claim, resort to the judgment of Hon’ble Supreme Court in case of R.C. Gupta (Supra), has been taken and consequently, the Circular dated
31.05.2017, distinguishing petitioners from an unexempted establishment/ trusts and denying to pay pension on the basic of actual salary, has been challenged.

In addition, counsel for petitioners have placed reliance on the previous Circular dated 23.03.2017 issued by the Employees’ Provident Fund Commissioner, which has been revised vide impugned Circular dated 31.05.2017 and submits that by issuing impugned Circular dated 31.05.2017, EPF Commissioner has make out an artificial and unreasonable classification that the previous Circular dated 23.03.2017, is applicable only for unexempted trusts and the benefit of Circular dated 23.03.2017 is not liable to be extended to the employees from exempted trusts.
4. Counsel for petitioners has further strongly placed reliance on a subsequent judgment of the Hon’ble Supreme Court in case of The Employees Provident Fund Organisation Vs. Sunil Kumar B. [(2023) 12 SCC 701], wherein the Apex Court has affirmed the ratio decidendi expounded in the judgment of R.C. Gupta (Supra) that the optee members of EPF Scheme, are entitled for pension on the basic of actual salary, instead of ceiling limit, hence, it has been prayed that respondents be directed to govern the case of petitioners for grant of pension under EPF [2025:RJ-JP:26166] (14 of 20) [CW-6498/2019] scheme following the judgment of Hon’ble Supreme Court in case of Sunil Kumar B. (Supra).
5. On behalf of respondents No.1 to 3, a joint reply to the writ petition has been filed stating inter alia that the ratio decidendi of the judgment of Hon’ble Supreme Court delivered in case of R.C. Gupta (Supra) is not applicable to the employees, who have worked in an exempted establishment. The reasons have been narrated in Clause a, b & c of the Para No.1 of the preliminary objections. It has clearly been stated that the judgment of R.C. Gupta (Supra) is applicable only to the employees of unexempted establishment, who made contribution during service period towards pension fund on the actual salary and superannuated prior to 01.09.2014. Since petitioners are ex-employees of exempted establishment (RIICO) and their provident fund account is being maintained by the private trust, created by the establishment itself, as much as EPFO never received contribution from the employer of petitioners of actual salary, hence, the claim of petitioners for entitlement of pension on the basic of actual salary instead of ceiling limit, is fictitious, hypothetical and baseless.
6. In Additional Affidavit filed by Sh. Shailendra Kumar Jain, Regional Provident Fund Commissioner- II, in the Office of EPF Organization, by and on behalf of respondent Nos. 1 to 3, it has been stated inter alia that provident fund scheme and pension scheme are entirely different. The Apex Court has noted in case of Sunil Kumar B. (Supra) that pension scheme offers characteristically different benefits from the provident fund scheme. The provident fund scheme provides one time settlement [2025:RJ-JP:26166] (15 of 20) [CW-6498/2019] at the time of exiting of member of scheme, whereas pension scheme commences monthly payment w.e.f. date of exiting of member from the scheme. It has been pointed out that since petitioners never opted to contribute in the provident fund scheme as per proviso to Paragraph 11(3) of the unamended pension scheme, hence, they cannot be permitted to get benefit of provident fund scheme, retrospectively.
7. In the reply filed by respondent No.4- RIICO, it has been contended that Circular dated 31.05.2017, issued by the Employees’ Provident Fund Organization, is binding upon answering respondent. It has been stated that answering respondent is an exempted trust in accordance with Circular dated
31.05.2017.
8. Reply on behalf of respondent No.5 has also been filed separately.
9. Learned counsel for respondents have vehemently contended that petitioners were employees of exempted establishment and in case of R.C. Gupta (Supra) so also in case of Sunil Kumar B. (Supra), Hon’ble Supreme Court refrained itself to deal with the pension scheme for the employees of exempted establishments. The attention of this Court has been drawn to a portion of Para No.37 of the judgment of Sunil Kumar B. (Supra), which is being reproduced hereunder:- “37. We shall now address the question as to whether the members from an exempted establishment under the 1952 Act would be entitled to the benefits of enrolling in the scheme beyond the ceiling limit. We would point out here that before us no argument has been advanced as regards members of the pension scheme of exempted establishments in terms of paragraph 39 of the said scheme. [2025:RJ-JP:26166] (16 of 20) [CW-6498/2019] Thus, in this judgment, we are not addressing the cases of that category of members……...”
10. Heard rival contentions of learned counsel for both parties and perused the material available on record.
11. A bare perusal of Circular dated 23.03.2017 (Ann.11) and impugned Circular dated 31.05.2017 (Ann.14), enclosed with SBCWP No. 6498/2019, indicates that both circulars have been issued in respect of subject matter for allowing benefits to the members of Employees’ Pension Scheme, 1995, on the actual salary in pension fund, exceeding wage limit of either Rs.5000/- or Rs.6500/-per month from the effective date retrospectively, as per judgment of Hon’ble Supreme Court delivered in case of R.C. Gupta (Supra).

In the Circular dated 23.03.2017, it was declared that a member, contributing to the Provident Fund on the wages exceeding the statutory ceiling limit, who had contributed to the Provident Fund on the wages exceeding statutory ceiling, cannot be debarred from exercising the option to contribute on such higher wages to the pension fund. However, simultaneously, while referring to the judgment of Hon’ble Supreme Court in case of R.C. Gupta (Supra), it has been observed and noted in Para No.2 that a beneficial scheme, ought not to be allowed to be defeated by reference to a cut-off date, particularly, in a situation where (as present case), the employer had deposited 12% of the actual salary and not 12% of the ceiling limit of Rs.5000/- or Rs.6500/- per month, as the case may be.

It appears that the Circular dated 31.05.2017, which has been impugned herein by the petitioners, is a clarificatory circular to the previous Circular dated 23.03.2017, to the effect that [2025:RJ-JP:26166] (17 of 20) [CW-6498/2019] previous circular deals with the case of employees, belonging to unexempted trust, as it has clearly been observed in this Circular dated 31.05.2017 that all the appellants-employees in the case of R.C. Gupta (Supra) before the Supreme Court, were from exempted establishments i.e. an establishment making PF contributions in the statutory Provident Fund managed by the EPFO. In the unexempted establishments, the Employer’s Contribution of 12% under the Act in respect of its employees, appellants-employees before the Apex Court, was on actual salary and not on the ceiling limit of either Rs.5000/- or Rs.6500/- per month. In this context. it is informed as under: office i. Approval to comply with the order of the Hon'ble Supreme Court in the matter of Shri R.C. Gupta and others is only in respect of the Provident Fund & Pension members whose accounts are maintained by EPPO and whose P.F. Contribution on higher wages has been received by EPFO. All the appellant employees in the aforesaid case before the Hon'ble Supreme Court were from unexempted establishment i.e. an establishment ii. [2025:RJ-JP:26166] (18 of 20) [CW-6498/2019] making P.F. contributions in the statutory Provident Fund managed by EPFO. The Employer's contribution of 12% under the Act in respect of the said employees was on actual salary and not on the ceiling limit of either Rs.5,000/- or Rs.6500/. iii. Exercise of option under Para 26 (6) of the EPF Scheme, 1952 is a precursor to exercise of option under proviso to clause 11 (3) of the pension scheme. The appellant employees in the aforesaid case had exercised option, under para 26 (6) of the EPF Scheme and contribution on full salary received in the statutory Provident Fund. iv. Employees’ Pension Scheme remittances are being made by the establishments and not by the exempted Trusts. As such if establishments with exempted trusts are allowed to make balance remittances on full salary to the Employees Pension scheme afresh, the same will have to be considered for unexempted establishments also. It is not contemplated in the judgment. In the case of exempted establishment the Provident Fund and Pension Fund are managed by separate legal entities. The Provident Fund of employees of exempted establishments are managed by Exempted Trusts and Pension Fund is managed by EPFO. As such, adjustment of contribution from Provident Fund Account to Pension Account as contemplated in the judgment is not possible. v. The matter was placed in the 40" PEIC meeting. As decided in the 40* meeting of the PEIC the matter will be placed before the CBT. In the interim, it is advised that no member of EPS, 95 whose contribution on full salary has not been received in the account of the EPFO at the respective periods of contribution, shall he eligible for the benefits contemplated in the judgment as per the aforesaid Hon'ble Supreme Court order. 14. Indisputably, petitioners were employees of exempted establishment/ trust. It has been clarified by respondents in their reply that from the employer of petitioners, no contribution of 12% on the actual salary of its employees, was received by EPFO in the provident fund account. The employees of exempted establishment are governed by their respective provident fund scheme of concerned establishment and are managed by their respective Board of Trustees. It has been clarified by the respondents that employees of exempted trust, do not pay their PF contribution to EPFO, hence, they cannot seek benefits of Pension Scheme from EPFO.
15. In the Circular dated 31.05.2017, it has been clarified that the judgment delivered by Apex Court in case of R.C. Gupta [2025:RJ-JP:26166] (19 of 20) [CW-6498/2019] (Supra), deals with employees from unexempted establishments. In the Employees’ Pension Scheme, remittance are being made by establishment and not by the exempted trust. It is further clarified in the Circular that in case of exempted establishment, Provident Fund and Pension Fund are managed by separate legal entities. The Provident Fund of employees of exempted establishments, are managed by the exempted trust and Pension Fund have been managed by EPFO. As such, adjustment of contribution from Provident Fund Account to Pension Account, in respect of employees of exempted establishment, is not possible.
16. In such view of the matter, this Court finds that the Circular dated 31.05.2017 may not be held to be issued in contravention to the dictum expounded by Hon’ble Supreme Court in case of R.C. Gupta (Supra), hence, there is no substance in the prayer of petitioners, to quash the Circular dated 31.05.2017.
17. As far as reliance, sought to be placed by counsel for petitioners on the judgment delivered in case of Sunil Kumar B. (Supra) is concerned, a bare perusal of Para No.37, as quoted hereinabove, makes it clear that in this case, Hon’ble Supreme Court never dealt with matter of employees, belonging to exempted trust. Hence, such case does not support the case of present petitioners.

In addition to above, it has emerged before this Court during course of arguments that near-about 41 writ petitioners out of 79 in SBCWP No.6498/2019 and 50 writ petitioner out of 89 in SBCWP No.6477/2019, have opted Old Pension Scheme, hence their claim for pension under EPF Scheme, 1952, does not survive. 19. The net outcome of discussions & enunciation made hereinabove, is that petitioners are not entitled for the relief prayed in writ petitions and consequently, both writ petitions are hereby dismissed.
