1. Since common question of facts and law is involved in all these petitions, hence with the consent of counsel for the parties, matters are taken up for final disposal and are being decided by this common order.
2. For convenience the facts and prayer mentioned in SB Civil Writ Petition No.8491/2017 has been taken into consideration. The instant writ petition has been filed with the following prayer: “(i) In view of the above cogent facts, law and circumstances of the case this Hon'ble Court may graciously be pleased to accept and allow this writ petition. (ii) By an appropriate writ order or direction the impugned order dated 05.10.2016 (Annex.-11) issued by the respondent No.3 may kindly be quashed and set aside. (iii) By an appropriate order or direction the order dated 05.10.2016 may kindly be modified suitably as per amended Rules 2012 and 2015 in this regard. (28 of 30) [CW-8491/2017] (iv) By an appropriate writ order or direction the respondents be restrained not to make any recovery from the pay and emoluments of the petitioner. Any order appropriate writ, order or direction, which this Hon'ble Court deems fit and proper in the facts and circumstances of the case, may also be passed in favour of the petitioner.”

By way of filing of this petition, a challenge has been led to the impugned order dated 05.10.2016 passed by the Director, Medical and Health Services, Jaipur by which a decision has been taken to grant notional benefits to the petitioners with effect from the date of their promotion & DPC and grant them actual benefits with effect from the date of their promotion.
4. Recovery proceedings have been initiated against all the petitioners for the period during which they did not join the promotion post.
5. Learned counsel for the State respondents apprised this Court that much water has flown after passing of the order impugned. Counsel submits that on 11.09.2017, the effect and operation of the recovery order was kept in abeyance by the Department of Medical and Health. Subsequently, an amendment was brought in the Rajasthan Medical and Health Service Rules, 2017 (for short 'the Rules of 2017'). Counsel submits that the following amendment has been made on
14.12.2017 under Rule 24BB. The said amendment reads as under: "(6)(i) Medical Officers promoted under DACP for the first time during the period from 11.07.2011 to (29 of 30) [CW-8491/2017]
31.03.2014 shall be allowed actual payment of Pay and Allowances from the date promotion became due, as one time exception. (ii) In the case of promotion under DACP between 01.04.2014 to 31.03.2018, the actual payment of Pay and Allowances on promotion under DACP shall be payable with effect from the date of their actual joining on promotion under DACP and for the period from the date of eligibility of promotion under DACP i.e. from next 1 April of the eligibility year to the date of joining pay shall be fixed on notional basis. (iii) On or after 01.04.2018, cash benefit on promotion under DACP will be admissible from the date on which it becomes due irrespective of the date of Joining."
6. Counsel submits that under the changed circumstances, no cause of action survives with the petitioners to continue with these petitions and the same are liable to be dismissed.

Considering the above factual aspect of the matter and looking to the fact that during pendency of these petitions, subsequent events have occurred and a notification has been issued by the Department of Personnel on 14.12.2017 by which amendment has been brought under Rule 24BB of the Rules of 2017 and the same has not been challenged in these petitions, the matter is required to be decided by the respondents afresh after affording due opportunity of hearing to all the petitioners. This Court takes a judicial notice of the of the fact that while passing the order impugned, no opportunity of hearing was provided to the petitioners and the order impugned was passed ex-parte without affording any opportunity of hearing to them, which has violated the principles of natural justice. 8. In view of the above, all these petitions stand disposed of granting liberty to the petitioners to approach the authorities concerned by way of filing detailed representation within a period of one month from the date of receipt of certified copy of this order.
9. The respondents are further directed to decide the same after affording due opportunity of hearing to each petitioner and pass orders strictly in accordance with law, expeditiously as early as possible, preferably within a period of three months thereafter.
10. Till then, no recovery proceedings would be initiated against the petitioners.
11. Since the petitioners are not aware about passing of this order, a copy of this order be sent on the residential addresses of each of the petitioners, mentioned in the memo of cause title of the petitions.
12. The stay applications and all pending applications, if any, also stand disposed of.
13. Needless to observe that in case any adverse order is passed against the petitioners, they would be at liberty to approach appropriate forum of law for redressal of their grievances. KuD/1-58 (ANOOP KUMAR DHAND),J
