On instructions, learned counsel for the petitioners submits that he wants to withdraw this bail application qua accused- petitioners Shishram S/o Palaram and Omprakash Alias Prakash S/o Palaram with the liberty to file afresh after filing of charge- sheet.

In view of the above, this S.B. Criminal Miscellaneous Bail Application is dismissed as withdrawn qua accused-petitioners [2026:RJ-JP:16207] (2 of 3) [CRLMB-5000/2026] Shishram S/o Palaram and Omprakash Alias Prakash S/o Palaram with the liberty as prayed.
This instant bail application has been filed on behalf of the accused-petitioner Dalip S/o Palaram under Section 483 of BNSS in connection with FIR No. 25/2025 registered at Police Station Khetri Nagar, District Jhunjhunu for the offence(s) under Sections 189(2), 115(2), 126(2), 329(3) & 110 of BNS.
Learned counsel for the petitioner Dalip submits that the petitioner has been falsely implicated in this case; he is custody since 25.02.2026. He further submits that similarly situated co- accused namely Manish Aliash Manesh and Rakesh Bagadiya have been enlarged on bail by the Co-ordinate Bench of this Court, vide order dated 22.01.2026 in S.B. Criminal Miscellaneous Bail Application No.237/2026. He further submits that injuries sustained by Ram Singh And Banarsi Davi are attributed to co- accused Prakash and Shishram; conclusion of trial may take a long time, so no fruitful purpose would be served by keeping the petitioner behind the bars and, therefore, prays that the petitioner may be granted the benefit of bail under Section 483 of BNSS.
Per contra, learned Public Prosecutor vehemently opposes the bail application and submits that one another criminal antecedent is registered against the accused-petitioner Dalip under Sections 341, 323, 447, 427 & 34 of IPC.
Having regard to the totality of the facts and circumstances of the case and considering the fact that accused-petitioner Dalip is behind the bars since 25.02.2026; similarly situated co-accused namely Manish Aliash Manesh and Rakesh Bagadiya have been enlarged on bail by the Co-ordinate Bench of this Court; trial will [2026:RJ-JP:16207] (3 of 3) [CRLMB-5000/2026] take its own time. Hence, this Court without expressing any opinion on the merits/demerits of the case, deems it just and proper to enlarge the petitioner Dalip S/o Palaram on bail.
Therefore, this bail application under Section 483 BNSS is accordingly, allowed and the accused-petitioner Dalip S/o Palaram is ordered to be released on bail, provided he furnishes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the trial Court, with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
It is made clear that the accused-petitioner Dalip shall not involve himself in any other offence(s) during currency of the bail and he shall mark his presence on 1st and 15th day of every month in the concerned police station.
In case of any breach of the aforementioned conditions, the learned Public Prosecutor shall be free to move the application against the accused-petitioner Dalip for cancellation of the bail before the concerned Court.
The observation made hereinabove is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner.
