1. By way of filing this writ petition, a challenge has been made to the impugned order dated 22.12.2023 passed by the Board of Revenue (for short, “the Board”) by which the order dated
18.09.2023 passed by the SDO has been quashed and set-aside ex-parte.

Learned counsel for the petitioner submits that the application submitted by the petitioner was allowed by the SDO vide order dated 18.09.2023 against which a revision petition was submitted by the respondents before the Board and the same has been allowed vide impugned order dated 22.12.2023, without even issuing any notice and without affording any opportunity of hearing. Counsel submits that the aforesaid order has been [2025:RJ-JP:32586] (4 of 5) [CW-3906/2024] passed in utter violation of the principle of natural justice, hence, the same is not sustainable in the eye of law and the same is liable to be quashed and set-aside, hence, interference of this Court is warranted.
3. Per contra, learned counsel for the respondents opposes the arguments raised by counsel for the petitioner, but he is not in a position to controvert the submission made by counsel for the petitioner.
4. Heard and considered the submissions made at the Bar and perused the material available on record.
5. Perusal of the record indicates that the order dated
18.09.2023 has been passed by the SDO, after hearing both the sides, which was assailed by the respondents by way of filing the revision petition, before the Board and the Board vide its impugned order dated 22.12.2023 has not only allowed the revision petition, but also quashed and set-aside the order dated
18.09.2023 passed by the SDO, before passing the aforesaid order, neither any notice nor any opportunity of hearing was provided to the petitioner, which has resulted in utter violation of principle of natural justice.
6. It is settled proposition of law that before passing any adverse order against a person, opportunity of hearing is required to be given to such person, however, in the instant case, no such opportunity was granted to the petitioner.
7. On this count alone, the impugned order dated 22.12.2023 passed by the respondents is not sustainable in the eye of law and is liable to be and is hereby quashed and set-aside. The instant writ petition stands allowed. The matter is remitted to the Board [2025:RJ-JP:32586] (5 of 5) [CW-3906/2024] for fresh disposal of the revision petition submitted by the respondents.
8. The parties are directed to appear before the Board on
15.09.2025.
9. It is expected from the Board to decide the revision petition afresh, after providing due opportunity of hearing to both the sides.
