No.6936/2007 Shakil Versus State Date of Order ::: 07/02/08 Hon'ble Mr. Justice Ajay Rastogi Mr. NA Naqvi, for applicant Mr. R.P.Kuldeep, Public Prosecutor for State Heard learned counsel for applicant as well as the learned Public Prosecutor and perused the material/record made available for perusal at the time of arguments. Applicant is facing trial for offences U/Ss 366, 376, 384, 342, 120-B, IPC. It has been pointed out by Public Prosecutor that prosecutrix has alleged in her statements recorded U/Ss 161 & 164, CrPC and so also during trial, which corroborates her version for alleged offences. Taking into consideration all the facts & circumstances and without expressing any opinion on merits of the case, this Court does not find justification for grant of post-arrest bail U/s 439, CrPC to accused-applicant (Shakil). Consequently bail application stands dismissed. However, it is expected of learned trial Court to expedite the trial. (Ajay Rastogi), J.
