HON'BLE MR.JUSTICE MOHAMMAD RAFIQ Shri V.K. Sharma for the petitioner. Shri Amit Punia, P.P. for the State. ****** Heard learned counsel for the petitioner, learned Public Prosecutor for the State and perused the relevant documents placed before me. Contention of the learned counsel for the petitioner is that the allegation against the petitioner is that she was one amongst other 15 accused, who went to attack the complainant party and that the main allegation of causing injury by knife to the deceased Pooran and two injured is on Shankar for which the offence u/s.302 and 307 IPC respectively are alleged to have been committed. Petitioner has been falsely implicated in this case. Even otherwise, she being a woman is entitled to be granted benefit u/s. 437 of Cr.P.C. She is in jail from 26.6.2010. Trial will take a long time and there is no previous case registered against the petitioner. Learned Public Prosecutor has opposed the bail application. Without expressing any opinion on the merits of this case but taking into 2 consideration all the facts and circumstances of the case, I deem it appropriate to enlarge the petitioner on bail. In the result, this bail application u/S.439 Cr.P.C. is allowed and it is directed that petitioner Sumitra W/o Ram Prasad Khatik shall be released on bail in F.I.R. No.192/2010, P.S. Karni Vihar, Distt. Jaipur for offence u/s.147, 148, 149, 302, 307 and 341 of IPC on her furnishing a personal bond in the sum of Rs.30,000/- together with two sureties in the sum of Rs.15,000/- each to the satisfaction of the trial Court for her appearance before that court on all dates of hearing and as and when called upon to do so till conclusion of the trial.
