Since Rule 3 of the Rules of 1972 has already been considered and the word 'ordinarily' has already been interpreted as 'not necessarily', therefore, respondents cannot refuse to accept and consider the applications of the petitioners, subject to other conditions. The present matters are fully covered by decisions of this Court in Krishna & Anr. Vs. State of Rajasthan (supra) & Geeta Devi Vs. State of Rajasthan (supra). ,d vU; U;kf;d fofu'p; vkseizdk'k mQZ fo".kq&cuke&jktLFkku jkT; [k.MihB nkf.Md fjV ;kfpdk la[;k 384@2022 esa izfrcaf/kr /kkjk dk vijk/k gksus ds vk/kkj ij [kqyk canh f'kfoj esa canh dks Hkstus ds izkFkZuk&i= dks fujLr djus ds vkns'k dks vikLr djrs gq, fuEukuqlkj izs{k.k fd;k x;k gS& The application filed on his behalf for being sent to the Open Air Camp has been dismissed by the State Level Committee vide recommendation dated 10.03.2022 assigning the reason that the petitioner has been convicted for the offence under Section 460 IPC, which a restricted category offence under the Rajasthan Prisoners Open Air Camp Rules,1972 (for short, ‘the Rules of 1972’) and hence, he is not entitled to be sent to the Open Air Camp. Be that as it may. This legal aspect was considered by this Court in the case of Sandeep S/o Shri Navrangi Goswami Vs. State of Rajasthan (D.B. Criminal Writ Petition No.532/2021 decided on 23.11.2021) and it was held that the word “ordinarily” used in Rule 3(d) of the Rules of 1972 for the ineligibility imposed for admission to Open Air Camp cannot be treated to be an absolute prohibition. Shri Bhati submits that pursuant to the said judgment, the convict Sandeep, who too was sentenced for a restricted category offence, has been sent to the Open Air Camp.
