(b) Prisoners convicted under section 326A, 364, 364A, 376A, 376B, 376E, 396, 460 of the Indian Penal Code 1860 and section 376 connec- ted with 302 of the Indian Penal Code 1860 (rape with murder). (c) Prisoners convicted under the Unlawful Activities (Prevention) Act, 1967 (Central Act No. 37 of 1967). jktLFkku canh dkjkodk'k ij fjgk fu;e 2021 ds fu;e 11 esa vkikr ¼emergent½ ekeyksa esa iSjksy ij canh dks NksMs+ tkus dk izko/kku gS] ;g fu;e Hkh fuEu izdkj ls gSa& "Emergent cases.- (1) Notwithstanding anything contain in rule 5,6, and 10, in emergent cases, involving humanitarian consideration, such as,- (i) critical condition on account of illness of any close relative i.e. father, mother, wife, husband, children, brother or un-married sister; (ii) death of any such close relative; (iii) serious damage to life or property from any natural calamity; (iv) Marriage of a Prisoner, his/her son or daughter or his/her brothers/ sister in case his/her parents are not alive; and (v) delivery of Prisoners wife,a prisoner, may be released on parole for a period not exceeding seven days by the Superintendent of the Jail and for a period not exceeding fifteen days by [2025:RJ-JP:39059] (4 of 6) [CRLW-254/2025] the Inspector General of Prisons or District Magistrate on such terms and conditions as they may, consider necessary to impose for the secur- ity of the prisoner including a guarantee for his return to the Jail, ac- ceptance or execution whereof would be a condition precedent to the release of such a prisoner on parole. bl U;k;ky; dh [k.MihB }kjk Mh-ch- nkf.Md fjV ;kfpdk la[;k 199@2024 eksrhjke cuke jktLFkku ljdkj o vU; esa ikfjr fu.kZ; fnukafdr 28-02-2024 esa fuEu fl)kUr izfrikfnr fd;k x;k gS& "8. The Court is mindful of the legislative intent of the POCSO Act which provides that the contact between the accused and the victim should be prevented in order to minimise the trauma experienced by the child. Ac- cording to us, if the victim is faced with the presence of convict-peti- tioner, it would have an adverse impact on her mental well-being and he/she would be forced to re-visit the trauma and be reminded of the incident which she would be trying hard to forget.

9. But then, a balance has to be struck between the safety and emo- tional aspect of the victim and statutory rights of the accused. We are of the opinion that such balance would be achieved if the accused spends his time of parole at a place which is away from victim's residence. Such order would take care of the apprehension/anxiety expressed by learned AAG.

Another aspect is that for circumstances and provisions of IPC men- tioned in Rule 16(1) a prisoner is ineligible for release on parole till hav - ing served half of the sentence including remission. In case, release of the petitioner covered under Rule 16(1) is to be delayed till serving of half of the sentence it shall defeat the basic purpose of Rule 11 provid- ing for emergent release on humanitarian consideration.
