Special Appeals Writ No. 210/2021 & 228/2021:-

1. These appeals have been filed by the appellants against the order dated 12.02.2021 passed by learned Single Judge of this Court.

2. Admittedly, the appellants were engaged on contract basis through a placement agency. There was no relationship of employees and employer between the appellants and respondents-State.

3. Learned Single Judge considering this aspect of the matter dismissed the writ petition filed on behalf of appellants. [2025:RJ-JP:33613-DB] (7 of 7) [SAW-210/2021]

4. The Hon’ble Supreme Court in the matter “K. K. Suresh versus Food Corporation of India”, 2018 AIR SCW 3905, in paragraph 10, held as under: “It is for the simple reasons that first, the case at hand arose out of the writ petitions whereas the case relied on arose out of industrial reference decided by the Industrial Tribunal; Second, the facts involved in the case at hand clearly prove that there did not exist any kind of employee and employer relationship between the appellants and the FCI; and lastly, there is no parity of any nature noticed on facts in the case at hand and the case relied on by the appellants.”

5. We are in a complete agreement with the view taken by the learned Single Judge.

6. In our considered view, the learned Single Judge has rightly dismissed the writ petition filed on behalf of appellant-writ petitioner as there was no relationship of employees and employer between the appellants and respondents-State.

7. In that view of the matter no case is made out for interference. Hence, this appeal is dismissed. D.B. Special Appeal Writ No. 638/2021 & 608/2021:- Learned counsel for the appellants is not pressing these appeals. Hence, the appeals are dismissed as withdrawn.
