Narain HON'BLE MR. JUSTICE SUDESH BANSAL Order 09/07/2025

1. Heard learned counsel for both the parties and perused the material available on record.

2. In the instant writ petition, petitioners raised two kinds of grievances:- (i) Non-registration by the Rajasthan Para Medical Council despite having degree of Course of B.Sc.-MLT and B.Sc.-RIT from the recognized University. (ii) Not allowing the petitioners in the recruitment for the post of Lab Technician and Assistant Radiographer, pursuant [2025:RJ-JP:25325] (3 of 4) [CW-2331/2021] to advertisement No.2/2020 dated 12.06.2020, merely for want of registration with the Rajasthan Para Medical Council.

3. It has been pointed by learned counsel for the petitioners that both the issues have been answered by the Coordinate Bench of this Court in a Bunch of writ petition, lead case being SBCWP No.8908/2020: Lalit Kishor Vs. State of Rajasthan & Ors., decided vide order dated 23.10.2020 and the directions issued in this writ petition have been slightly modified by the Division Bench vide order dated 06.05.2024, passed in DBSAW No.66/2021: Rajasthan Para Medical Council Vs. Tara Chand Sharma & Ors.

4. It has further been pointed out that in furtherance thereto Rajasthan Para Medical Council has registered the petitioners in their respective courses, hence, as far as grievance (i) is concerned, same stands satisfied.

5. As far as grievance (ii) is concerned, it has been pointed out that petitioners have participated in the recruitment process pursuant to the interim order and in Para no. 12.9 of the order dated 23.10.2020, following directions were made:- “12.9 Keeping in view the controversy which this Court has decided in the foregoing Issue Nos. E, G and H, it is apparent that the petitioners therein possess the requisite qualification having passed Diploma from University duly recognized with the UGC and recognized by the State Government, but their registration was not done by the Rajasthan Para Medical Council. As this Court had already directed the Rajasthan Para Medical Council to register the candidates within a period of 15 days henceforth, the natural corollary is that such candidates must be allowed to submit those registration before the appointing authority for the purpose of consideration of their candidature for appointment as [2025:RJ-JP:25325] (4 of 4) [CW-2331/2021] per their merit on the posts of Lab Technician and Assistant Radiographer” Such directions have been affirmed by the Division Bench.

6. It has been prayed that the candidature of petitioners is required to be considered for appointment on merits.

7. The counsel appearing on behalf of respective respondents does not dispute the prayer made by the petitioners. Thus candidature of petitioners is required to be considered by the Selection Board on merits for the post in question, in furtherance to the directions referred hereinabove.

8. Hence, the instant writ petition is disposed of with the direction to the respondent-Staff Selection Board to consider the candidature of petitioners on merits for the post in question, in furtherance to the directions reproduced in para 12.9 of the order dated 23.10.2020, which have been affirmed by the Division Bench in DBSAW No.66/2021: Rajasthan Para Medical Council Vs. Tara Chand Sharma & Ors.

9. Accordingly, both applications (1/2022 & 1/2025) stand disposed of. TN/46 (SUDESH BANSAL),J
