JUSTICE NARENDRA SINGH DHADDHA 12/03/2025 Order The instant appeal has been filed by the appellant- applicant(for short ‘the applicant’) under Section 96 CPC against the order dated 17.12.2024 passed by the District Judge, Jhunjhunu (for short ‘the trial court’) in Civil Miscellaneous Application No.72/2024 titled as “Jai Prakash Vs. Amar Singh & Anr.”, by which the trial court dismissed the application filed by the applicant under Section 7 of the Provincial Insolvency Act, 1920. Learned counsel for the applicant submits that Provincial Insolvency Act, 1920 is still in existence. The trial court while deciding the issue of maintainability, considered the Mental Health Act, 1987. There was no occasion to apply the Mental Health Act, 1987 in the present matter. So, the order dated 17.12.2024 passed by the trial court be set-aside and the matter be remanded (4 of 4) [CFA-297/2025] to the trial court to proceed further in the matter after reserving issue of maintainability of the application. I have heard learned counsel for the applicant and perused the impugned order dated 17.12.2024. When Provincial Insolvency Act, 1920 is still in existence, the trial court committed error in deciding the issue of maintainability of the application while applying the Mental Health Act, 1987. So, the appeal filed by the applicant is allowed and the order dated

17.12.2024 passed by the trial court is set-aside. The trial court is directed to proceed further in the matter after reserving the issue of the maintainability of the application and after issuing summons to the opposite party. The applicant is directed to appear before the trial court on
