04.07.2016 with a further prayer to direct the respondents to consider the services rendered by the petitioners from their initial date of appointment till regular selection, to extend them other service benefits and to pay them regular pay scale during the period of probation. Indisputably, the petitioners have an alternative and efficacious remedy for redressal of their grievance(s) before the Rajasthan Civil Services Appellate Tribunal, Jaipur. The writ petition is bereft of any averment as to why the writ jurisdiction of this Court is invoked without exhausting the alternative and efficacious remedy available to them. When confronted with the aforesaid situation, learned Senior Counsel for the petitioners submits that since the writ petition was filed in the year 2020 wherein, notice has already been issued, they should not be relegated to the alternative remedy at this stage. He further submits that limitation would also come in way of approaching the Tribunal. This Court is not convinced that mere pendency of this writ petition at the admission stage since the year 2020 would make it [2025:RJ-JP:18019] (6 of 6) [CW-2420/2020] maintainable in view of the alternative and efficacious remedy available to the petitioners for redressal of their grievance(s) raised in the writ petition. Moreso, when, no explanation is offered in the memo of writ petition as to why it should be entertained without exhausting the alternative remedy. So far as the question of limitation is concerned, it is open for the petitioners to move an appropriate application seeking condonation of delay before the learned Tribunal which, obviously, is under an obligation to decide the same in accordance with the law keeping in view the period of pendency of this writ petition before this Court. Resultantly, this writ petition is dismissed for availability of the alternative and efficacious remedy to the petitioners.
