1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.66/2024, registered at Police Station Special Police Station (SOG), District ATS & SOG for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC and Sections 3, 4, 6 and 10 of The Rajasthan Public Examination (Measures to Prevent Unfair Means in Recruitment) Act, 2022.
2. Learned counsel for the petitioners submits that the accused- petitioners have falsely been implicated in this case. It is argued [2025:RJ-JP:3503] (4 of 5) [CRLMB-463/2025] that the accused-petitioners are in custody since long and the charge-sheet has already been produced before the concerned Court. It is alleged against the accused-petitioners that they were found using bluetooth device while taking examination conducted by the R.P.S.C. for the post of EO/RO. It is further contended that similarly placed other co-accused have already been enlarged on bail, the charge-sheet itself is voluminous having 97 witnesses and trial of the case may take considerable time, therefore, these bail applications of the accused-petitioners may be allowed.
3. Learned GA-cum-AAG has vehemently opposed the grant of bail applications. It is contended that the accused-petitioners appearing in the E.O./R.O. examination used bluetooth device and were indulged in cheating. It is also contended that the other co- accused Bhawna was enlarged on bail, as she delivered a baby and the other co-accused who were also enlarged on bail, were having different cases. It is argued that against the accused- petitioner-Praveen Kumar, one other case facilitating the other candidates in cheating were found and their cases were also registered against the accused-petitioner-Praveen Kumar, therefore, considering the allegations levelled against the accused- petitioners, these bail applications may be dismissed.
5. Heard and perused the material available on the record. The accused-petitioners are behind the bars since long and charge-sheet has already been produced. The charge-sheet itself is voluminous having 97 witnesses, therefore, considering the above facts without going into merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused-petitioners namely; 1. Sunil Jakhar S/o Shri Chaina Ram, 2. Ram Singh S/o Ramniwas, 3. Om Prakash S/o Ghasi Ram, 4. Ms. Nirma Manda D/o Shri Ramgopal Manda, 5. Anil Saran S/o Shri Omprakash Saran, 6. Sunil Dhayal S/o Shri Rajaram, 7. Praveen Kumar S/o Shri Mohan Lal, 8. Rajaram S/o Shri Lumbaram and 9. Deepak Prajapat S/o Shri Murlidhar Prajapat, in connection FIR No.66/2024, registered at Police Station Special Police Station (SOG), District ATS & SOG, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
