Matter comes up on an application (IA No.1/2024) filed by the respondents under Article 226(3) of the Constitution of India for vacating the ex-parte stay order dated 08.01.2024 passed by a Co-ordinate Bench of this Court.
During the course of arguments, learned counsel for the parties requested the Court to dispose of the writ petition in terms of the order passed by a Co-ordinate Bench of this Court vide order dated 30.08.2024 in S.B. Civil Writ Petition [2025:RJ-JP:31092] (2 of 2) [CW-145/2024] No.14048/2023; Rahul Kumar Garg Vs. State of Rajasthan & Ors.
Operative part
Accordingly this writ petition is disposed of with the following directions:
(1) The petitioner is at liberty to submit a representation against the suspension order dated 21.04.2023 within a period of four weeks from today.
(2) The respondents are directed to consider the application for reviewing the suspension order vide a reasoned and speaking order taking into consideration the submissions made by the petitioner in its representation within a period of twelve weeks from the date of receipts of its communication to the peti- tioner.
(3) Till decision is review, interim order passed by this Court dated 08.01.2024 shall remain effective.
In case, the petitioner fails to file a representation within the four weeks from today, the ex-parte interim order dated
08.01.2024 shall stand vacated forthwith.
It is made clear that this order has been passed solely to expedite the grievance redressal of the petitioner and this Court has not expressed any opinion on the merits/demerits of the case. The concerned authority is directed to decide the representation independently in accordance with law without being influenced by this order.
