HON'BLE MR.H.R.PANWAR,J. Mr. Sandeep Mehta for the petitioner. Mr. J.P.S.Choudhary, P.P. Mr. Ramesh Purohit for the complainant. Heard learned counsel for the petitioner and public prosecutor for the State assisted by counsel for the complainant. Perused the order impugned. By order dated 10.1.2008 the petitioner was directed to return the dowry articles. Again by order dated 21.1.2008, the petitioner was directed to return the dowry articles failing which the interim order will be vacated. The matter again came up on

28.1.2008 but the dowry articles have not been returned. Learned public prosecutor submits that he has received the case diary but the dowry articles have not been returned. Despite opportunities and granting interim bail, the dowry articles have not been returned. In the circumstances, therefore, keeping in view the gravity of offence, in my view, it is not a fit case to release the petitioner on anticipatory bail. The bail application filed by the petitioner under Section 438 Cr.P.C. is therefore, dismissed. (H.R.PANWAR), J.
