D.B. CIVIL SPECIAL APPEAL (W) NO. 278/2006. State & Ors. Vs. Sahdev Singh Ranawat (Alongwith 8 other connected matters) The learned counsel for the parties are ad idem that the // 2 // matters involving akin issues have already been considered and finally decided by this Court and even the petition for special leave to appeal before the Hon'ble Supreme Court has been dismissed. The learned counsel have referred to the order dated 21.04.2006 as passed by a co-ordinate Bench in the case of Panna Lal Joshi Vs. The State of Rajasthan & Ors. [2006 (6) RDD 3458 (Raj.)] wherein, while allowing similar nature claim, a co-ordinate Bench directed as under:- “As a result this appeal is allowed. The judgment under appeal is set aside. The writ petition is allowed. The Respondent Nos. 1 to 3 are directed to consider the case of the petitioner-appellant for appointment, if on the basis of his marks obtained in the Senior Secondary (Vocational) and by excluding the consideration of marks obtained in optional subjects in Bridge Course he finds place in order of merit in accordance with the directions issued in Vinod Kumar's case.” The learned counsel for the parties have further referred to the order dated 04.04.2011 as passed in D.B. Civil Special Appeal (Writ) No. 04324/2009 (DR (J) : State of Rajasthan & Ors. Vs. Lalit Kumar Jain & Anr. that reads as under:- “Delay is condoned for the reasons stated. It is conceded that similar matter has been dismissed by this Court vide order dated 13.1.2009 in D.B. Civil Special Appeal No. 667/2008. Following order was passed- “Heard learned counsel for the appellant. This appeal is directed against the order dated 20.10.2005 passed by a learned Single Judge of this Court in Writ Petition No. 2188/2005 D.B. CIVIL SPECIAL APPEAL (W) NO. 278/2006. State & Ors. Vs. Sahdev Singh Ranawat (Alongwith 8 other connected matters) // 3 // whereby and whereunder the writ application was disposed of in the light of the judgment rendered by this Court in S.B. Civil Writ Petition No. 4818/2003 (Vinod Kumar V. State of Rajasthan & Ors.). We are informed that the judgment rendered in Vinod Kumar (supra) was challenged before the Apex Court and the Special Leave to Appeal of the State was dismissed. In that view of the matter, the judgment rendered in Vinod Kumar (supra) has attained finality and thus the impugned order cannot be faulted.” The appeal lacks merit and is dismissed.” In view of the aforesaid, this appeal is also dismissed.” It is also pointed out that since after rendering of the decision in the present cases, the writ-petitioners have been accorded appointment on the post of PTI Gr.III and they are continuing as such.
